16 | 16 | | BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF TENNESSEE: |

17 | 17 | | SECTION 1. Tennessee Code Annotated, Section 38-7-109, is amended by adding the |
---|
18 | 18 | | following as a new subsection: |

19 | 19 | | (c) |

20 | 20 | | (1) |
---|
21 | 21 | | (A) If a county medical examiner's office or regional forensic center is |
---|
22 | 22 | | conducting an autopsy on a decedent who is suspected to have committed a |
---|
23 | 23 | | mass shooting that resulted in the deaths of four (4) or more individuals, then the |
---|
24 | 24 | | county medical examiner or regional forensic center shall consult such |
---|
25 | 25 | | decedent's treating mental health professional or primary care physician, if |
---|
26 | 26 | | known and reasonably able to be identified through the decedent's next of kin, to |
---|
27 | 27 | | obtain information regarding the decedent's psychotropic drug use. |
---|
28 | 28 | | (B) The county medical examiner shall test the decedent for the |
---|
29 | 29 | | presence of any drugs, including psychotropic drugs. |

31 | 31 | | (A) The county medical examiner's office or regional forensic center shall |
---|
32 | 32 | | disclose the drug use of the decedent to the University of Tennessee's health |
---|
33 | 33 | | science center and to the department of health. |
---|
34 | 34 | | (B) The county medical examiner's office or regional forensic center shall |
---|
35 | 35 | | not disclose any identifying information including the decedent's name or social |
---|

40 | 40 | | security number when disclosing the drug use of the decedent to the University |
---|
41 | 41 | | of Tennessee's health science center and to the department of health. |

42 | 42 | | (3) The University of Tennessee's health science center shall study the drug |
---|
43 | 43 | | interactions between the psychotropic drugs and any other drugs that were present in |
---|
44 | 44 | | the decedent's system as provided by the county medical examiner as described in |
---|
45 | 45 | | subdivision (c)(2)(A). |
---|
46 | 46 | | (4) The University of Tennessee's health science center shall submit quarterly |
---|
47 | 47 | | reports of all data obtained pursuant to this section to the chair of the health and welfare |
---|
48 | 48 | | committee of the senate and the chair of the house of representatives committee having |
---|
49 | 49 | | jurisdiction over health-related matters. |
---|
50 | 50 | | (5) As used in this subsection (c), "psychotropic drug" means a medication |
---|
51 | 51 | | prescribed for the treatment of mental or behavioral health conditions or a drug |
---|
52 | 52 | | prescribed for any condition that exercises a direct effect upon the central nervous |
---|
53 | 53 | | system and that is capable of influencing and modifying mood, perceptions, and |
---|
54 | 54 | | behavior, including: |
---|
55 | 55 | | (A) Agents for control of mania and depression; |
---|
56 | 56 | | (B) Antidepressants; |
---|
57 | 57 | | (C) Antipsychotics; |
---|
58 | 58 | | (D) Anxiolytics; |
---|
59 | 59 | | (E) Hypnotics; |
---|
60 | 60 | | (F) Mood stabilizers; |
---|
61 | 61 | | (G) Hormonal medication with the primary goal of altering a person's |
---|
62 | 62 | | physical appearance and sexual characteristics existing at the person's birth; |
---|
63 | 63 | | (H) Psychomotor stimulants; and |
---|
64 | 64 | | (I) Stimulants. |

69 | 69 | | (6) The county medical examiner, regional forensic center, department of health, |
---|
70 | 70 | | and the University of Tennessee's health science center must follow all relevant state |

71 | 71 | | and federal privacy laws related to the implementation of this section. |

72 | 72 | | SECTION 2. This act takes effect July 1, 2025, the public welfare requiring it. |
