1212 AN ACT to amend Tennessee Code Annotated, Title 38;
1313 Title 53; Title 63 and Title 68, relative to
1414 psychotropic drugs.

1616 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF TENNESSEE:
1717 SECTION 1. Tennessee Code Annotated, Section 38-7-109, is amended by adding the
1818 following as a new subsection:
1919 (c)
2020 (1)
2121 (A) If a county medical examiner's office or regional forensic center is
2222 conducting an autopsy on a decedent who is suspected to have committed a
2323 mass shooting that resulted in the deaths of four (4) or more individuals, then the
2424 county medical examiner or regional forensic center shall consult such
2525 decedent's treating mental health professional or primary care physician, if
2626 known and reasonably able to be identified through the decedent's next of kin, to
2727 obtain information regarding the decedent's psychotropic drug use.
2828 (B) The county medical examiner shall test the decedent for the
2929 presence of any drugs, including psychotropic drugs.

3131 (A) The county medical examiner's office or regional forensic center shall
3232 disclose the drug use of the decedent to the University of Tennessee's health
3333 science center and to the department of health.
3434 (B) The county medical examiner's office or regional forensic center shall
3535 not disclose any identifying information including the decedent's name or social

4040 security number when disclosing the drug use of the decedent to the University
4141 of Tennessee's health science center and to the department of health.
4242 (3) The University of Tennessee's health science center shall study the drug
4343 interactions between the psychotropic drugs and any other drugs that were present in
4444 the decedent's system as provided by the county medical examiner as described in
4545 subdivision (c)(2)(A).
4646 (4) The University of Tennessee's health science center shall submit quarterly
4747 reports of all data obtained pursuant to this section to the chair of the health and welfare
4848 committee of the senate and the chair of the house of representatives committee having
4949 jurisdiction over health-related matters.
5050 (5) As used in this subsection (c), "psychotropic drug" means a medication
5151 prescribed for the treatment of mental or behavioral health conditions or a drug
5252 prescribed for any condition that exercises a direct effect upon the central nervous
5353 system and that is capable of influencing and modifying mood, perceptions, and
5454 behavior, including:
5555 (A) Agents for control of mania and depression;
5656 (B) Antidepressants;
5757 (C) Antipsychotics;
5858 (D) Anxiolytics;
5959 (E) Hypnotics;
6060 (F) Mood stabilizers;
6161 (G) Hormonal medication with the primary goal of altering a person's
6262 physical appearance and sexual characteristics existing at the person's birth;
6363 (H) Psychomotor stimulants; and
6464 (I) Stimulants.

6969 (6) The county medical examiner, regional forensic center, department of health,
7070 and the University of Tennessee's health science center must follow all relevant state
7171 and federal privacy laws related to the implementation of this section.
7272 SECTION 2. This act takes effect July 1, 2025, the public welfare requiring it.
