16 | 16 | | BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF TENNESSEE: |

17 | 17 | | SECTION 1. Tennessee Code Annotated, Section 49-6-6001(j), is amended by |
---|
18 | 18 | | designating the existing language as subdivision (1) and adding the following new subdivision: |

19 | 19 | | (2) |
---|
20 | 20 | | (A) A student who is an English language learner (ELL) and who |
---|
21 | 21 | | received language assistance services in the classroom during the school year |
---|
22 | 22 | | must be allowed to receive the same language assistance services while taking a |
---|
23 | 23 | | TCAP test or an end-of-course assessment, required by the state board of |
---|
24 | 24 | | education under subsection (a), as long as the receipt of language assistance |
---|
25 | 25 | | services does not invalidate the assessment. |
---|
26 | 26 | | (B) As used in this subdivision (j)(2), "language assistance services" |
---|
27 | 27 | | means services: |
---|
28 | 28 | | (i) Designed for speakers of languages other than English that |
---|
29 | 29 | | are provided pursuant to an individual learning plan (ILP) by a teacher |
---|
30 | 30 | | with an English as a second language endorsement to ELL students; or |
---|
31 | 31 | | (ii) That provide linguistically and academically appropriate |
---|
32 | 32 | | accommodations and scaffolding pursuant to an ELL student's ILP that |
---|
33 | 33 | | are provided by a general education teacher in the general education |
---|
34 | 34 | | classroom to ELL students whose parent or guardian has waived the |
---|
35 | 35 | | student's receipt of the services described in subdivision (j)(2)(B)(i). |

40 | 40 | | SECTION 2. This act takes effect upon becoming a law, the public welfare requiring it, |

41 | 41 | | and applies to the administration of the TCAP test in the 2025-2026 school year and each |
