16 | 16 | | BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF TENNESSEE: |

17 | 17 | | SECTION 1. Tennessee Code Annotated, Section 40-32-101, is amended by adding |
---|
18 | 18 | | the following as a new subsection: |
---|
19 | 19 | | (p) |
---|
20 | 20 | | (1) Notwithstanding subsections (g), (k), and (m), effective July 1, 2025, |
---|
21 | 21 | | for purposes of this subsection (p), "eligible petitioner" means a person who: |
---|
22 | 22 | | (A) Is seeking expunction of an offense that: |
---|
23 | 23 | | (i) Is eligible for expunction under subdivision (g)(1); and |
---|
24 | 24 | | (ii) Occurred at least ten (10) years after the person's |
---|
25 | 25 | | conviction for an offense under § 55-10-401; |
---|
26 | 26 | | (B) Has fulfilled all requirements of the sentence imposed by the |
---|
27 | 27 | | court for the offense the person is seeking to expunge, including: |
---|
28 | 28 | | (i) Payment of all fines, restitution, court costs, and other |
---|
29 | 29 | | assessments for the offense; |
---|
30 | 30 | | (ii) Completion of any term of imprisonment or probation |
---|
31 | 31 | | for the offense; and |
---|
32 | 32 | | (iii) Meeting all conditions of supervised or unsupervised |
---|
33 | 33 | | release for the offense; |
---|
34 | 34 | | (C) Has not previously been granted expunction under subsection |
---|
35 | 35 | | (g), subsection (k), or subsection (m); and |
---|
36 | 36 | | |

40 | 40 | | (D) Has not been convicted of an offense under § 55-10-401 |
---|
41 | 41 | | more than one (1) time. |

42 | 42 | | (2) A person may petition for expunction of an offense under this |
---|
43 | 43 | | subsection (p) only one (1) time. |
---|
44 | 44 | | (3) Subdivisions (g)(3)-(6), (8), (12), and (13) apply to a petition filed |
---|
45 | 45 | | under this subsection (p). |
---|
46 | 46 | | SECTION 2. This act takes effect upon becoming a law, the public welfare requiring it. |
