1212 AN ACT to amend Tennessee Code Annotated, Title 40,
1313 Chapter 32, Part 1, relative to expunction of
1414 criminal records.

1616 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF TENNESSEE:
1717 SECTION 1. Tennessee Code Annotated, Section 40-32-101, is amended by adding
1818 the following as a new subsection:
1919 (p)
2020 (1) Notwithstanding subsections (g), (k), and (m), effective July 1, 2025,
2121 for purposes of this subsection (p), "eligible petitioner" means a person who:
2222 (A) Is seeking expunction of an offense that:
2323 (i) Is eligible for expunction under subdivision (g)(1); and
2424 (ii) Occurred at least ten (10) years after the person's
2525 conviction for an offense under § 55-10-401;
2626 (B) Has fulfilled all requirements of the sentence imposed by the
2727 court for the offense the person is seeking to expunge, including:
2828 (i) Payment of all fines, restitution, court costs, and other
2929 assessments for the offense;
3030 (ii) Completion of any term of imprisonment or probation
3131 for the offense; and
3232 (iii) Meeting all conditions of supervised or unsupervised
3333 release for the offense;
3434 (C) Has not previously been granted expunction under subsection
3535 (g), subsection (k), or subsection (m); and

4040 (D) Has not been convicted of an offense under § 55-10-401
4141 more than one (1) time.
4242 (2) A person may petition for expunction of an offense under this
4343 subsection (p) only one (1) time.
4444 (3) Subdivisions (g)(3)-(6), (8), (12), and (13) apply to a petition filed
4545 under this subsection (p).
4646 SECTION 2. This act takes effect upon becoming a law, the public welfare requiring it.
