12	12	AN ACT to amend Tennessee Code Annotated, Title 49,
13	13	relative to education.

15	15	BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF TENNESSEE:
16	16	SECTION 1. Tennessee Code Annotated, Section 49-10-1403, is amended by deleting
17	17	subsection (e) and substituting:
18	18	(e)
19	19	(1) A parent of a participating student:
20	20	(A) Shall ensure that the participating student is annually
21	21	administered all Tennessee comprehensive assessment program (TCAP)
22	22	tests, or successor tests authorized by the state board of education, that
23	23	are administered to a public school student in the same grade or same
24	24	course subject as the participating student;
25	25	(B) In grade eleven (11) shall ensure that the student is
26	26	administered the examination that is administered to public school
27	27	students in grade eleven (11) pursuant to § 49-6-6001(b)(1); and
28	28	(C) In any of the grades kindergarten through three (K-3) shall
29	29	ensure that the participating student is annually administered each of the
30	30	three (3) Tennessee universal reading screeners, or universal reading
31	31	screeners approved by the state board of education, as described in § 49-
32	32	1-905(c), during each of the three (3) administration windows established
33	33	by the department of education pursuant to § 49-1-905(c)(1).
34	34	(2) A participating student's results on the tests administered pursuant to
35	35	this subsection (e) must be reported to the parent of the student.

40	40	(3) Students with disabilities who would have participated in the alternate
41	41	assessment, as determined on the student's IEP, are exempt from the
42	42	requirements in this subsection (e).
43	43	SECTION 2. Tennessee Code Annotated, Section 49-10-1404, is amended by adding
44	44	the following as new subsections:
45	45	(d)
46	46	(1) A participating school shall publish the school's lesson plans and
47	47	syllabus for each class offered by the school, a current list of materials in the
48	48	school's library collection, and the academic standards for each class offered by
49	49	the school on the school's website.
50	50	(2) As used in this subsection (d):
51	51	(A) "Library collection" means the materials made available to
52	52	students by the participating school, including materials made available to
53	53	students as part of a course curriculum; and
54	54	(B) "Materials" means books, periodicals, newspapers,
55	55	manuscripts, films, prints, documents, microfilm, discs, cassettes,
56	56	videotapes, video games, applications, and subscription content in any
57	57	form.
58	58	(e) A participating school shall ensure that all educators of the participating
59	59	school hold a valid license to teach in a public school that is issued by the state board of
60	60	education.
61	61	SECTION 3. Tennessee Code Annotated, Section 49-6-2607(e), is amended by adding
62	62	the following as new subdivisions:

68	68	(A) Publish the school's lesson plans and syllabus for each class offered
69	69	by the school, a current list of materials in the school's library collection, and the
70	70	academic standards for each class offered by the school on the school's website;

72	72	(B) As used in this subdivision (e)(6):
73	73	(A) "Library collection" means the materials made available to
74	74	students by the participating school, including materials made available to
75	75	students as part of a course curriculum; and
76	76	(B) "Materials" means books, periodicals, newspapers,
77	77	manuscripts, films, prints, documents, microfilm, discs, cassettes,
78	78	videotapes, video games, applications, and subscription content in any
79	79	form; and
80	80	(7) Ensure that all educators of the participating school hold a valid license to
81	81	teach in a public school that is issued by the state board of education.
82	82	SECTION 4. Tennessee Code Annotated, Section 49-6-2606(a)(1), is amended by
83	83	deleting the subdivision and substituting:
84	84	(1) As a condition of participating in the program:
85	85	(A) Participating students must be annually administered the Tennessee
86	86	comprehensive assessment program (TCAP) tests, or successor tests authorized
87	87	by the state board of education, that are administered to a public school student
88	88	in the same grade or same course subject as the participating student;
89	89	(B) Participating students in grade eleven (11) must be administered the
90	90	examination that is administered to public schools students in grade eleven (11)
91	91	pursuant to § 49-6-6001(b)(1); and

96	96	(C) Participating students in kindergarten through grade three (K-3) must
97	97	annually be administered each of the three (3) Tennessee universal reading
98	98	screeners, or universal reading screeners approved by the state board of
99	99	education, as described in § 49-1-905(c), during each of the three (3)
100	100	administration windows established by the department of education pursuant to §
101	101	49-1-905(c)(1).
102	102	SECTION 5. This act takes effect July 1, 2025, the public welfare requiring it.
