1212 AN ACT to amend Tennessee Code Annotated, Title 49,
1313 relative to education.

1515 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF TENNESSEE:
1616 SECTION 1. Tennessee Code Annotated, Section 49-10-1403, is amended by deleting
1717 subsection (e) and substituting:
1818 (e)
1919 (1) A parent of a participating student:
2020 (A) Shall ensure that the participating student is annually
2121 administered all Tennessee comprehensive assessment program (TCAP)
2222 tests, or successor tests authorized by the state board of education, that
2323 are administered to a public school student in the same grade or same
2424 course subject as the participating student;
2525 (B) In grade eleven (11) shall ensure that the student is
2626 administered the examination that is administered to public school
2727 students in grade eleven (11) pursuant to § 49-6-6001(b)(1); and
2828 (C) In any of the grades kindergarten through three (K-3) shall
2929 ensure that the participating student is annually administered each of the
3030 three (3) Tennessee universal reading screeners, or universal reading
3131 screeners approved by the state board of education, as described in § 49-
3232 1-905(c), during each of the three (3) administration windows established
3333 by the department of education pursuant to § 49-1-905(c)(1).
3434 (2) A participating student's results on the tests administered pursuant to
3535 this subsection (e) must be reported to the parent of the student.

4040 (3) Students with disabilities who would have participated in the alternate
4141 assessment, as determined on the student's IEP, are exempt from the
4242 requirements in this subsection (e).
4343 SECTION 2. Tennessee Code Annotated, Section 49-10-1404, is amended by adding
4444 the following as new subsections:
4545 (d)
4646 (1) A participating school shall publish the school's lesson plans and
4747 syllabus for each class offered by the school, a current list of materials in the
4848 school's library collection, and the academic standards for each class offered by
4949 the school on the school's website.
5050 (2) As used in this subsection (d):
5151 (A) "Library collection" means the materials made available to
5252 students by the participating school, including materials made available to
5353 students as part of a course curriculum; and
5454 (B) "Materials" means books, periodicals, newspapers,
5555 manuscripts, films, prints, documents, microfilm, discs, cassettes,
5656 videotapes, video games, applications, and subscription content in any
5757 form.
5858 (e) A participating school shall ensure that all educators of the participating
5959 school hold a valid license to teach in a public school that is issued by the state board of
6060 education.
6161 SECTION 3. Tennessee Code Annotated, Section 49-6-2607(e), is amended by adding
6262 the following as new subdivisions:

6868 (A) Publish the school's lesson plans and syllabus for each class offered
6969 by the school, a current list of materials in the school's library collection, and the
7070 academic standards for each class offered by the school on the school's website;

7272 (B) As used in this subdivision (e)(6):
7373 (A) "Library collection" means the materials made available to
7474 students by the participating school, including materials made available to
7575 students as part of a course curriculum; and
7676 (B) "Materials" means books, periodicals, newspapers,
7777 manuscripts, films, prints, documents, microfilm, discs, cassettes,
7878 videotapes, video games, applications, and subscription content in any
7979 form; and
8080 (7) Ensure that all educators of the participating school hold a valid license to
8181 teach in a public school that is issued by the state board of education.
8282 SECTION 4. Tennessee Code Annotated, Section 49-6-2606(a)(1), is amended by
8383 deleting the subdivision and substituting:
8484 (1) As a condition of participating in the program:
8585 (A) Participating students must be annually administered the Tennessee
8686 comprehensive assessment program (TCAP) tests, or successor tests authorized
8787 by the state board of education, that are administered to a public school student
8888 in the same grade or same course subject as the participating student;
8989 (B) Participating students in grade eleven (11) must be administered the
9090 examination that is administered to public schools students in grade eleven (11)
9191 pursuant to § 49-6-6001(b)(1); and

9696 (C) Participating students in kindergarten through grade three (K-3) must
9797 annually be administered each of the three (3) Tennessee universal reading
9898 screeners, or universal reading screeners approved by the state board of
9999 education, as described in § 49-1-905(c), during each of the three (3)
100100 administration windows established by the department of education pursuant to §
101101 49-1-905(c)(1).
102102 SECTION 5. This act takes effect July 1, 2025, the public welfare requiring it.
