| 16 | 16 | | BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF TENNESSEE: |

| 17 | 17 | | SECTION 1. Tennessee Code Annotated, Title 49, Chapter 6, Part 50, is amended by |
|---|
| 18 | 18 | | adding the following as a new section: |
|---|
| 19 | 19 | | (a) The department of health shall make available and require blood lead level |
|---|
| 20 | 20 | | testing for all children prior to attendance at public schools that service any combination |
|---|
| 21 | 21 | | of pre-kindergarten through grade twelve (pre-K-12) students. |
|---|
| 22 | 22 | | (b) A child tested pursuant to this section who has elevated blood lead levels |
|---|
| 23 | 23 | | must be immediately screened to determine if educational services pursuant to the |
|---|
| 24 | 24 | | Individuals with Disabilities Education Act (20 U.S.C. ยง 1400 et seq.) may be required. |
|---|
| 25 | 25 | | (c) A child tested pursuant to this section who has lead poisoning must receive |
|---|
| 26 | 26 | | mandated wraparound services appropriate for lead poisoned children. |
|---|
| 27 | 27 | | (d) This section does not apply to a child whose parent or guardian opts out of |
|---|
| 28 | 28 | | such testing or referrals required by this section. |
|---|
| 29 | 29 | | SECTION 2. Tennessee Code Annotated, Title 37, Chapter 1, Part 1, is amended by |
|---|
| 30 | 30 | | adding the following as a new section: |
|---|
| 31 | 31 | | If a juvenile detention facility that receives federal funding is aware that a juvenile |
|---|
| 32 | 32 | | in custody of such detention facility has elevated blood lead levels or lead poisoning, |
|---|
| 33 | 33 | | then the detention facility shall, in collaboration with the department of health and local |
|---|
| 34 | 34 | | education agencies, provide wraparound services appropriate for children with elevated |
|---|
| 35 | 35 | | blood lead levels or lead poisoning for such juvenile. |

| 40 | 40 | | SECTION 3. Tennessee Code Annotated, Title 68, Chapter 1, Part 1, is amended by |

| 41 | 41 | | adding the following as a new section: |

| 42 | 42 | | The department shall make available and require blood lead level testing for a |
|---|
| 43 | 43 | | pregnant woman who receives vouchers for the special supplemental food program for |
|---|
| 44 | 44 | | women, infants, and children administered by the department. If a woman is tested |
|---|
| 45 | 45 | | pursuant to this section and it is determined that she has elevated blood lead levels or |
|---|
| 46 | 46 | | lead poisoning, then the department shall provide the woman specialized nutritional |
|---|
| 47 | 47 | | services, education on how to mitigate lead in the body, and other mandated |
|---|
| 48 | 48 | | wraparound services tailored for people with elevated blood lead levels or lead |
|---|
| 49 | 49 | | poisoning. |
|---|
| 50 | 50 | | SECTION 4. This act takes effect upon becoming a law, the public welfare requiring it. |
