1313 AN ACT to amend Tennessee Code Annotated, Title 8;
1414 Title 33; Title 53; Title 56; Title 63; Title 68 and
1515 Title 71, relative to prescription drugs.

1717 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF TENNESSEE:
1818 SECTION 1. Tennessee Code Annotated, Title 53, Chapter 10, Part 2, is amended by
1919 adding the following as a new section:
2020 (a) On or before January 1, 2026, the department of finance and administration,
2121 in collaboration with the department of health and the division of TennCare, shall submit
2222 a request to the United States secretary of health and human services for approval of
2323 the ability to import safe and effective prescription drugs from Canada pursuant to 21
2424 U.S.C. ยง 384. The request must, at a minimum:
2525 (1) Demonstrate how the prescription drugs imported into this state will
2626 meet the applicable federal and state standards for safety and effectiveness;
2727 (2) Demonstrate how the drugs imported into this state will comply with
2828 federal law for the pharmaceutical distribution supply chain as described in the
2929 Drug Supply Chain Security Act (Title II of Pub. L. No. 113-54);
3030 (3) Include a list of proposed prescription drugs that have the highest
3131 potential for cost savings to this state through importation at the time that the
3232 request is submitted;
3333 (4) Estimate this state's total annual cost savings from importation of
3434 prescription drugs from Canada;
3535 (5) Estimate this state's total annual cost of importation of prescription
3636 drugs from Canada; and

4141 (6) Include a list of potential Canadian suppliers from which this state
4242 would import drugs and demonstrate that the suppliers are in full compliance with
4343 relevant Canadian federal and provincial laws and regulations as well as all
4444 applicable federal and state laws and regulations.
4545 (b) Upon receipt of federal approval, the department of finance and
4646 administration shall notify the governor, the speaker of the senate, and the speaker of
4747 the house of representatives of such federal approval.
4848 (c) Within six (6) months of receiving federal approval, the department of finance
4949 and administration, in collaboration with the department of health and the division of
5050 TennCare, shall submit a proposal to the governor, the speaker of the senate, and the
5151 speaker of the house of representatives to implement a program for the importation of
5252 safe and effective prescription drugs from Canada that have the highest potential for
5353 cost savings to this state.
5454 (d) The department of finance and administration, in collaboration with the
5555 department of health and the division of TennCare, is authorized to promulgate rules to
5656 effectuate this section. The rules must be promulgated in accordance with the Uniform
5757 Administrative Procedures Act, compiled in title 4, chapter 5.
5858 SECTION 2. This act takes effect upon becoming a law, the public welfare requiring it.
