17 | 17 | | BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF TENNESSEE: |

18 | 18 | | SECTION 1. Tennessee Code Annotated, Title 53, Chapter 10, Part 2, is amended by |
---|
19 | 19 | | adding the following as a new section: |
---|
20 | 20 | | (a) On or before January 1, 2026, the department of finance and administration, |
---|
21 | 21 | | in collaboration with the department of health and the division of TennCare, shall submit |
---|
22 | 22 | | a request to the United States secretary of health and human services for approval of |
---|
23 | 23 | | the ability to import safe and effective prescription drugs from Canada pursuant to 21 |
---|
24 | 24 | | U.S.C. ยง 384. The request must, at a minimum: |
---|
25 | 25 | | (1) Demonstrate how the prescription drugs imported into this state will |
---|
26 | 26 | | meet the applicable federal and state standards for safety and effectiveness; |
---|
27 | 27 | | (2) Demonstrate how the drugs imported into this state will comply with |
---|
28 | 28 | | federal law for the pharmaceutical distribution supply chain as described in the |
---|
29 | 29 | | Drug Supply Chain Security Act (Title II of Pub. L. No. 113-54); |
---|
30 | 30 | | (3) Include a list of proposed prescription drugs that have the highest |
---|
31 | 31 | | potential for cost savings to this state through importation at the time that the |
---|
32 | 32 | | request is submitted; |
---|
33 | 33 | | (4) Estimate this state's total annual cost savings from importation of |
---|
34 | 34 | | prescription drugs from Canada; |
---|
35 | 35 | | (5) Estimate this state's total annual cost of importation of prescription |
---|
36 | 36 | | drugs from Canada; and |
---|

41 | 41 | | (6) Include a list of potential Canadian suppliers from which this state |
---|
42 | 42 | | would import drugs and demonstrate that the suppliers are in full compliance with |
---|
43 | 43 | | relevant Canadian federal and provincial laws and regulations as well as all |
---|
44 | 44 | | applicable federal and state laws and regulations. |
---|
45 | 45 | | (b) Upon receipt of federal approval, the department of finance and |
---|
46 | 46 | | administration shall notify the governor, the speaker of the senate, and the speaker of |
---|
47 | 47 | | the house of representatives of such federal approval. |
---|
48 | 48 | | (c) Within six (6) months of receiving federal approval, the department of finance |
---|
49 | 49 | | and administration, in collaboration with the department of health and the division of |
---|
50 | 50 | | TennCare, shall submit a proposal to the governor, the speaker of the senate, and the |
---|
51 | 51 | | speaker of the house of representatives to implement a program for the importation of |
---|
52 | 52 | | safe and effective prescription drugs from Canada that have the highest potential for |
---|
53 | 53 | | cost savings to this state. |
---|
54 | 54 | | (d) The department of finance and administration, in collaboration with the |
---|
55 | 55 | | department of health and the division of TennCare, is authorized to promulgate rules to |
---|
56 | 56 | | effectuate this section. The rules must be promulgated in accordance with the Uniform |
---|
57 | 57 | | Administrative Procedures Act, compiled in title 4, chapter 5. |
---|
58 | 58 | | SECTION 2. This act takes effect upon becoming a law, the public welfare requiring it. |
