1313 AN ACT to amend Tennessee Code Annotated, Title 49,
1414 Chapter 4, Part 10, relative to tuition assistance for
1515 members of the Tennessee national guard.

1717 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF TENNESSEE:
1818 SECTION 1. Tennessee Code Annotated, Section 49-4-1003, is amended by adding
1919 the following as new subdivisions:
2020 ( ) "Mandatory fees" means fees incurred by all students attending an
2121 educational institution; including, but not limited to:
2222 (A) Parking fees;
2323 (B) Technology fees; and
2424 (C) Library fees;
2525 ( ) "Master's degree program fees":
2626 (A) Means fees charged by an educational program or educational
2727 institution for a student to attend a master's degree program; and
2828 (B) Does not include tuition;
2929 ( ) "Undergraduate course fees":
3030 (A) Means fees charged by an educational program or educational
3131 institution for a student to attend an undergraduate course; and
3232 (B) Does not include tuition;
3333 SECTION 2. Tennessee Code Annotated, Section 49-4-1004(b), is amended by
3434 deleting the subsection and substituting instead the following:
3535 (b) Upon successful application by the eligible member attending a public
3636 educational institution, the department of military shall pay the educational institution an

4141 amount equal to one hundred percent (100%) of the maximum resident in-state tuition
4242 and, in an amount determined annually by the department of military's policy,
4343 undergraduate course fees or master's degree program fees charged by the educational
4444 institution attended for the educational program to which the member successfully
4545 applied, less all other state or federal financial assistance as described in § 49-4-1005.
4646 Such financial assistance must be credited first to the member's tuition, subject to § 49-
4747 4-1005.
4848 SECTION 3. Tennessee Code Annotated, Section 49-4-1005, is amended by adding
4949 the following as a new subdivision (9) and redesignating the current subdivision (9) and
5050 subsequent subdivisions accordingly:
5151 (9) A member is ineligible for tuition reimbursement pursuant to this part if the
5252 member is suspended from receiving federal tuition assistance due to academic
5353 performance or recoupment;
5454 SECTION 4. Tennessee Code Annotated, Section 49-4-1005(3), is amended by
5555 deleting "one hundred twenty (120) semester hours" wherever it appears and substituting "one
5656 hundred thirty (130) semester hours".
5757 SECTION 5. Tennessee Code Annotated, Section 49-4-1005(3), is amended by
5858 deleting "or eight (8) full-time equivalent semesters".
5959 SECTION 6. Tennessee Code Annotated, Section 49-4-1005(3), is amended by
6060 deleting subdivision (B), adding "or" at the end of subdivision (A), and redesignating subdivision
6161 (C) as subdivision (B).
6262 SECTION 7. Tennessee Code Annotated, Section 49-4-1005(11), is amended by
6363 deleting the subdivision and substituting:
6464 (11) Members must submit an application for tuition reimbursement under this
6565 part within forty-five (45) days of course completion.

7070 SECTION 8. Tennessee Code Annotated, Section 49-4-1008, is amended by deleting
7171 the section.
7272 SECTION 9. If a provision of this act or its application to a person or circumstance is
7373 held invalid, then the invalidity does not affect other provisions or applications of the act that can
7474 be given effect without the invalid provision or application, and to that end, the provisions of this
7575 act are severable.
7676 SECTION 10. This act takes effect upon becoming a law, the public welfare requiring it.
