13	13	AN ACT to amend Tennessee Code Annotated, Title 49,
14	14	Chapter 4, Part 10, relative to tuition assistance for
15	15	members of the Tennessee national guard.

17	17	BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF TENNESSEE:
18	18	SECTION 1. Tennessee Code Annotated, Section 49-4-1003, is amended by adding
19	19	the following as new subdivisions:
20	20	( ) "Mandatory fees" means fees incurred by all students attending an
21	21	educational institution; including, but not limited to:
22	22	(A) Parking fees;
23	23	(B) Technology fees; and
24	24	(C) Library fees;
25	25	( ) "Master's degree program fees":
26	26	(A) Means fees charged by an educational program or educational
27	27	institution for a student to attend a master's degree program; and
28	28	(B) Does not include tuition;
29	29	( ) "Undergraduate course fees":
30	30	(A) Means fees charged by an educational program or educational
31	31	institution for a student to attend an undergraduate course; and
32	32	(B) Does not include tuition;
33	33	SECTION 2. Tennessee Code Annotated, Section 49-4-1004(b), is amended by
34	34	deleting the subsection and substituting instead the following:
35	35	(b) Upon successful application by the eligible member attending a public
36	36	educational institution, the department of military shall pay the educational institution an

41	41	amount equal to one hundred percent (100%) of the maximum resident in-state tuition
42	42	and, in an amount determined annually by the department of military's policy,
43	43	undergraduate course fees or master's degree program fees charged by the educational
44	44	institution attended for the educational program to which the member successfully
45	45	applied, less all other state or federal financial assistance as described in § 49-4-1005.
46	46	Such financial assistance must be credited first to the member's tuition, subject to § 49-
47	47	4-1005.
48	48	SECTION 3. Tennessee Code Annotated, Section 49-4-1005, is amended by adding
49	49	the following as a new subdivision (9) and redesignating the current subdivision (9) and
50	50	subsequent subdivisions accordingly:
51	51	(9) A member is ineligible for tuition reimbursement pursuant to this part if the
52	52	member is suspended from receiving federal tuition assistance due to academic
53	53	performance or recoupment;
54	54	SECTION 4. Tennessee Code Annotated, Section 49-4-1005(3), is amended by
55	55	deleting "one hundred twenty (120) semester hours" wherever it appears and substituting "one
56	56	hundred thirty (130) semester hours".
57	57	SECTION 5. Tennessee Code Annotated, Section 49-4-1005(3), is amended by
58	58	deleting "or eight (8) full-time equivalent semesters".
59	59	SECTION 6. Tennessee Code Annotated, Section 49-4-1005(3), is amended by
60	60	deleting subdivision (B), adding "or" at the end of subdivision (A), and redesignating subdivision
61	61	(C) as subdivision (B).
62	62	SECTION 7. Tennessee Code Annotated, Section 49-4-1005(11), is amended by
63	63	deleting the subdivision and substituting:
64	64	(11) Members must submit an application for tuition reimbursement under this
65	65	part within forty-five (45) days of course completion.

70	70	SECTION 8. Tennessee Code Annotated, Section 49-4-1008, is amended by deleting
71	71	the section.
72	72	SECTION 9. If a provision of this act or its application to a person or circumstance is
73	73	held invalid, then the invalidity does not affect other provisions or applications of the act that can
74	74	be given effect without the invalid provision or application, and to that end, the provisions of this
75	75	act are severable.
76	76	SECTION 10. This act takes effect upon becoming a law, the public welfare requiring it.
