13 | 13 | | AN ACT to amend Chapter 87 of the Private Acts of 1985; and |

14 | 14 | | any other acts amendatory thereto, relative to the |

15 | 15 | | Charter of the City of Germantown. |

17 | 17 | | BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF TENNESSEE: |

18 | 18 | | SECTION 1. Chapter 87 of the Private Acts of 1985, and any other acts amendatory |
---|
19 | 19 | | thereto, is amended in Section 4.09 by adding the following language at the end of the section: |

20 | 20 | | The Mayor shall serve and devote his or her full attention to the duties of the |
---|
21 | 21 | | office of Mayor and serve the City, and its interests, in a full-time capacity, with |
---|
22 | 22 | | the salary therefor to be set via lawful ordinance by the Board of Mayor and |
---|
23 | 23 | | Aldermen, notwithstanding the provisions of Sec. 4.03 of the Charter, |
---|
24 | 24 | | commensurate with the typical duties exercised by, and obligations imposed |
---|
25 | 25 | | upon, a full-time mayor. |

26 | 26 | | SECTION 2. |
---|
27 | 27 | | This act shall have no effect unless it is approved by a majority of the number of |
---|
28 | 28 | | qualified voters of the City of Germantown voting in an election to take place on the first |
---|
29 | 29 | | Tuesday of May, 2026, on the question of whether or not the act should be approved, |
---|
30 | 30 | | provided that a primary election is held in Shelby County on that same day; otherwise, |
---|
31 | 31 | | the election shall take place on August 6, 2026, at the same time as the Shelby County |
---|
32 | 32 | | general election. |
---|
33 | 33 | | The ballots used in the election shall have printed on them the language |
---|
34 | 34 | | contained in Section 1 of this act and the voters shall vote for or against its approval. |
---|
35 | 35 | | The votes cast on the question shall be canvassed and the results proclaimed by |
---|
36 | 36 | | the county election commissioners and certified by them to the secretary of state as |
---|
37 | 37 | | provided by law. |

42 | 42 | | The qualifications of voters voting on the question shall be the same as those |
---|
43 | 43 | | required for participation in primary elections or general elections, as applicable. All |

44 | 44 | | laws applicable to such elections shall apply to the determination of the approval or |
---|
45 | 45 | | rejection of this act. |

46 | 46 | | SECTION 3. For the purpose of approving or rejecting the provisions of this act, as |
---|
47 | 47 | | provided in Section 2, it shall not take effect until all votes cast on the binding referendum have |
---|
48 | 48 | | been counted and the results certified. |
