14 | 14 | | BE IT RESOLVED BY THE SENATE OF THE ONE HUNDRED FOURTEENTH |

15 | 15 | | GENERAL ASSEMBLY OF THE STATE OF TENNESSEE, THE HOUSE OF |

16 | 16 | | REPRESENTATIVES CONCURRING, that the General Assembly finds that "antisemitism" |
---|
17 | 17 | | means a certain perception of Jews, which may be expressed as hatred toward Jews, or |
---|
18 | 18 | | rhetorical and physical manifestations of antisemitism that are directed toward Jewish or non- |
---|
19 | 19 | | Jewish individuals and their property, or toward Jewish community institutions and religious |
---|
20 | 20 | | facilities, and includes, but is not limited to: |
---|
21 | 21 | | (1) Calling for, aiding, or justifying the killing or harming of Jews in the name of a |
---|
22 | 22 | | radical ideology or an extremist view of religion; |
---|
23 | 23 | | (2) Making mendacious, dehumanizing, demonizing, or stereotypical allegations |
---|
24 | 24 | | about Jews or the power of Jews collectively, including especially, but not exclusively, |
---|
25 | 25 | | the myth about a world Jewish conspiracy or of Jews controlling the media, economy, |
---|
26 | 26 | | government, or other societal institutions; |
---|
27 | 27 | | (3) Accusing Jews as a people of being responsible for real or imagined |
---|
28 | 28 | | wrongdoing committed by a single Jewish person or group, or even for acts committed |
---|
29 | 29 | | by non-Jews; |
---|
30 | 30 | | (4) Denying the fact, scope, mechanisms (e.g., gas chambers), or intentionality |
---|
31 | 31 | | of the genocide of the Jewish people at the hands of National Socialist Germany and its |
---|
32 | 32 | | supporters and accomplices during World War II (the Holocaust); |
---|
33 | 33 | | (5) Accusing the Jews as a people, or Israel as a state, of inventing or |
---|
34 | 34 | | exaggerating the Holocaust; |
---|

42 | 42 | | that the existence of a state of Israel is a racist endeavor; |
---|
43 | 43 | | (8) Applying double standards by requiring a behavior not expected nor |
---|
44 | 44 | | demanded of any other democratic nation; |
---|
45 | 45 | | (9) Using the symbols and images associated with classic antisemitism, |
---|
46 | 46 | | including claims of Jews killing Jesus or blood libel, to characterize Israel or Israelis; |
---|
47 | 47 | | (10) Drawing comparisons of contemporary Israeli policy to that of the Nazis; or |
---|
48 | 48 | | (11) Holding Jews collectively responsible for actions of the state of Israel. |
---|
49 | 49 | | BE IT FURTHER RESOLVED, that the General Assembly urges all state departments |
---|
50 | 50 | | and agencies to consider antisemitism as evidence of discriminatory intent for any law or policy |
---|
51 | 51 | | in this State that prohibits discrimination based on race, color, religion, or national origin. |
---|
52 | 52 | | BE IT FURTHER RESOLVED, that the General Assembly urges district attorneys |
---|
53 | 53 | | general to seek an enhanced sentence for any criminal defendant who intentionally selected the |
---|
54 | 54 | | person against whom the crime was committed or selected the property that was damaged or |
---|
55 | 55 | | otherwise affected by the crime, in whole or in part, because of the defendant's antisemitism. |
---|
56 | 56 | | BE IT FURTHER RESOLVED, that the General Assembly urges any state governmental |
---|
57 | 57 | | entity, local education agency, and institution of higher education that receives a complaint from |
---|
58 | 58 | | a person who alleges that antisemitism has occurred on the premises of a public school serving |
---|
59 | 59 | | any of the grades kindergarten through twelve or an institution of higher education, or through |
---|
60 | 60 | | electronic outreach from a public school serving any of the grades kindergarten through twelve |
---|
61 | 61 | | or an institution of higher education, to take into consideration the definition of antisemitism in |
---|
62 | 62 | | determining whether the alleged act was motivated by antisemitic intent. |
