77 relating to the authority of certain municipalities to extend the
88 termination date for a reinvestment zone created under the Tax
99 Increment Financing Act.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 311.017, Tax Code, is amended by adding
1212 Subsection (a-1) to read as follows:
1313 (a-1) This subsection applies only to a reinvestment zone
1414 created by a municipality that has a population of 195,000 or more
1515 and is the county seat of a county that has a population of 245,000
1616 or less. Notwithstanding Subsection (a)(1), a municipality by
1717 ordinance adopted subsequent to the ordinance adopted by the
1818 municipality creating a reinvestment zone may designate a
1919 termination date for the zone that is later than the termination
2020 date designated in the ordinance creating the zone but not later
2121 than the 20th anniversary of that date. If a municipality adopts an
2222 ordinance extending the termination date for a reinvestment zone as
2323 authorized by this subsection, the zone terminates on the earlier
2424 of:
2525 (1) the termination date designated in the ordinance;
2626 or
2727 (2) the date provided by Subsection (a)(2).
2828 SECTION 2. This Act takes effect immediately if it receives
2929 a vote of two-thirds of all the members elected to each house, as
3030 provided by Section 39, Article III, Texas Constitution. If this
3131 Act does not receive the vote necessary for immediate effect, this
3232 Act takes effect September 1, 2009.
