66 AN ACT
77 relating to the use, exhibition, or possession of a firearm by
88 public school students participating in certain school-sponsored
99 programs and activities sponsored or supported by the Parks and
1010 Wildlife Department.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 37.007, Education Code, is amended by
1313 amending Subsection (a) and adding Subsection (k) to read as
1414 follows:
1515 (a) Except as provided by Subsection (k), a [A] student
1616 shall be expelled from a school if the student, on school property
1717 or while attending a school-sponsored or school-related activity on
1818 or off of school property:
1919 (1) uses, exhibits, or possesses:
2020 (A) a firearm as defined by Section 46.01(3),
2121 Penal Code;
2222 (B) an illegal knife as defined by Section
2323 46.01(6), Penal Code, or by local policy;
2424 (C) a club as defined by Section 46.01(1), Penal
2525 Code; or
2626 (D) a weapon listed as a prohibited weapon under
2727 Section 46.05, Penal Code;
2828 (2) engages in conduct that contains the elements of
2929 the offense of:
3030 (A) aggravated assault under Section 22.02,
3131 Penal Code, sexual assault under Section 22.011, Penal Code, or
3232 aggravated sexual assault under Section 22.021, Penal Code;
3333 (B) arson under Section 28.02, Penal Code;
3434 (C) murder under Section 19.02, Penal Code,
3535 capital murder under Section 19.03, Penal Code, or criminal
3636 attempt, under Section 15.01, Penal Code, to commit murder or
3737 capital murder;
3838 (D) indecency with a child under Section 21.11,
3939 Penal Code;
4040 (E) aggravated kidnapping under Section 20.04,
4141 Penal Code;
4242 (F) aggravated robbery under Section 29.03,
4343 Penal Code;
4444 (G) manslaughter under Section 19.04, Penal
4545 Code;
4646 (H) criminally negligent homicide under Section
4747 19.05, Penal Code; or
4848 (I) continuous sexual abuse of young child or
4949 children under Section 21.02, Penal Code; or
5050 (3) engages in conduct specified by Section
5151 37.006(a)(2)(C) or (D), if the conduct is punishable as a felony.
5252 (k) A student may not be expelled solely on the basis of the
5353 student's use, exhibition, or possession of a firearm that occurs:
5454 (1) at an approved target range facility that is not
5555 located on a school campus; and
5656 (2) while participating in or preparing for a
5757 school-sponsored shooting sports competition or a shooting sports
5858 educational activity that is sponsored or supported by the Parks
5959 and Wildlife Department or a shooting sports sanctioning
6060 organization working with the department.
6161 SECTION 2. This Act applies beginning with the 2009-2010
6262 school year.
6363 SECTION 3. This Act takes effect immediately if it receives
6464 a vote of two-thirds of all the members elected to each house, as
6565 provided by Section 39, Article III, Texas Constitution. If this
6666 Act does not receive the vote necessary for immediate effect, this
6767 Act takes effect September 1, 2009.
