| 7 | 7 | | relating to a preference in state purchasing for products from |
|---|
| 8 | 8 | | disaster areas. |
|---|
| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter H, Chapter 2155, Government Code, is |
|---|
| 11 | 11 | | amended by adding Section 2155.454 to read as follows: |
|---|
| 12 | 12 | | Sec. 2155.454. PREFERENCE TO GOODS FROM DISASTER AREA. (a) |
|---|
| 13 | 13 | | In this section, "disaster area" means an area of this state that |
|---|
| 14 | 14 | | has been declared a disaster area by: |
|---|
| 15 | 15 | | (1) the governor under Chapter 418; or |
|---|
| 16 | 16 | | (2) the president of the United States under the |
|---|
| 17 | 17 | | Robert T. Stafford Disaster Relief and Emergency Assistance Act (42 |
|---|
| 18 | 18 | | U.S.C. Section 5121 et seq.). |
|---|
| 19 | 19 | | (b) The comptroller and each state agency procuring goods |
|---|
| 20 | 20 | | shall give preference to goods produced in a disaster area if: |
|---|
| 21 | 21 | | (1) the cost of the goods does not exceed the cost of |
|---|
| 22 | 22 | | other similar goods that are not produced in a disaster area; and |
|---|
| 23 | 23 | | (2) the quality of the goods equals or exceeds the |
|---|
| 24 | 24 | | quality of other similar goods that are not produced in a disaster |
|---|
| 25 | 25 | | area. |
|---|
| 26 | 26 | | (c) The preference required by this section applies |
|---|
| 27 | 27 | | beginning on the date the area is first declared to be a disaster |
|---|
| 28 | 28 | | area and ending on the first anniversary of that date, regardless of |
|---|
| 29 | 29 | | the date the declaration terminates or expires. |
|---|
| 30 | 30 | | (d) The comptroller and each state agency procuring goods |
|---|
| 31 | 31 | | shall adopt rules to implement this section. |
|---|
| 32 | 32 | | SECTION 2. As soon as practicable after the effective date |
|---|
| 33 | 33 | | of this Act, the comptroller of public accounts and each state |
|---|
| 34 | 34 | | agency procuring goods shall adopt rules necessary to implement |
|---|
| 35 | 35 | | Section 2155.454, Government Code, as added by this Act. |
|---|
| 36 | 36 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 37 | 37 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 38 | 38 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 39 | 39 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 40 | 40 | | Act takes effect September 1, 2009. |
