55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to authorizing certain municipalities and counties to
88 enter into interlocal contracts for the provision of law
99 enforcement services.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter C, Chapter 791, Government Code, is
1212 amended by adding Section 791.034 to read as follows:
1313 Sec. 791.034. CONTRACTS FOR THE PROVISION OF LAW
1414 ENFORCEMENT SERVICES IN CERTAIN MUNICIPALITIES. (a) This section
1515 applies only to:
1616 (1) a county with a population of more than 650,000
1717 located within 100 miles of an international border; and
1818 (2) a municipality located entirely in a county
1919 described by Subdivision (1).
2020 (b) A municipality that enters into an interlocal contract
2121 with a county under this chapter for the county to provide law
2222 enforcement services to the municipality may abolish its municipal
2323 police department.
2424 (c) A county that enters into an interlocal contract with a
2525 municipality under this chapter for the county to provide law
2626 enforcement services to the municipality must assign county law
2727 enforcement officers to discharge official duties in the
2828 municipality.
2929 SECTION 2. This Act takes effect immediately if it receives
3030 a vote of two-thirds of all the members elected to each house, as
3131 provided by Section 39, Article III, Texas Constitution. If this
3232 Act does not receive the vote necessary for immediate effect, this
3333 Act takes effect September 1, 2009.
