| 7 | 7 | | relating to the development, rehabilitation, or expansion of |
|---|
| 8 | 8 | | affordable housing in a public improvement district established by |
|---|
| 9 | 9 | | a county or municipality. |
|---|
| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Section 372.003(b), Local Government Code, is |
|---|
| 12 | 12 | | amended to read as follows: |
|---|
| 13 | 13 | | (b) A public improvement project may include: |
|---|
| 14 | 14 | | (1) landscaping; |
|---|
| 15 | 15 | | (2) erection of fountains, distinctive lighting, and |
|---|
| 16 | 16 | | signs; |
|---|
| 17 | 17 | | (3) acquiring, constructing, improving, widening, |
|---|
| 18 | 18 | | narrowing, closing, or rerouting of sidewalks or of streets, any |
|---|
| 19 | 19 | | other roadways, or their rights-of-way; |
|---|
| 20 | 20 | | (4) construction or improvement of pedestrian malls; |
|---|
| 21 | 21 | | (5) acquisition and installation of pieces of art; |
|---|
| 22 | 22 | | (6) acquisition, construction, or improvement of |
|---|
| 23 | 23 | | libraries; |
|---|
| 24 | 24 | | (7) acquisition, construction, or improvement of |
|---|
| 25 | 25 | | off-street parking facilities; |
|---|
| 26 | 26 | | (8) acquisition, construction, improvement, or |
|---|
| 27 | 27 | | rerouting of mass transportation facilities; |
|---|
| 28 | 28 | | (9) acquisition, construction, or improvement of |
|---|
| 29 | 29 | | water, wastewater, or drainage facilities or improvements; |
|---|
| 30 | 30 | | (10) the establishment or improvement of parks; |
|---|
| 31 | 31 | | (11) projects similar to those listed in Subdivisions |
|---|
| 32 | 32 | | (1)-(10); |
|---|
| 33 | 33 | | (12) acquisition, by purchase or otherwise, of real |
|---|
| 34 | 34 | | property in connection with an authorized improvement; |
|---|
| 35 | 35 | | (13) special supplemental services for improvement |
|---|
| 36 | 36 | | and promotion of the district, including services relating to |
|---|
| 37 | 37 | | advertising, promotion, health and sanitation, water and |
|---|
| 38 | 38 | | wastewater, public safety, security, business recruitment, |
|---|
| 39 | 39 | | development, recreation, and cultural enhancement; [and] |
|---|
| 40 | 40 | | (14) payment of expenses incurred in the |
|---|
| 41 | 41 | | establishment, administration, and operation of the district; and |
|---|
| 42 | 42 | | (15) the development, rehabilitation, or expansion of |
|---|
| 43 | 43 | | affordable housing. |
|---|
| 44 | 44 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 45 | 45 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 46 | 46 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 47 | 47 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 48 | 48 | | Act takes effect September 1, 2009. |
