66 AN ACT
77 relating to requiring a sexually oriented business to maintain
88 certain photographic identification records; providing a criminal
99 penalty.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Chapter 102, Business & Commerce Code, as
1212 effective April 1, 2009, is amended by adding Section 102.0031 to
1313 read as follows:
1414 Sec. 102.0031. REQUIREMENT TO MAINTAIN PHOTOGRAPHIC
1515 IDENTIFICATION RECORDS. (a) A sexually oriented business shall
1616 maintain at the business a record that contains a copy of a valid
1717 proof of identification of each employee or independent contractor
1818 working at the business.
1919 (b) A proof of identification satisfies the requirements of
2020 Subsection (a) if the identification:
2121 (1) contains a physical description and photograph
2222 consistent with the person's appearance;
2323 (2) contains the date of birth of the person; and
2424 (3) was issued by a government agency.
2525 (c) The form of identification under Subsection (a) may
2626 include:
2727 (1) a driver's license issued by this state or another
2828 state;
2929 (2) a passport; or
3030 (3) an identification card issued by this or another
3131 state or the federal government.
3232 (d) A sexually oriented business shall maintain a record
3333 under this section for at least five years after the date the
3434 employee or independent contractor ends employment with or a
3535 contractual obligation to the business.
3636 (e) The requirements of this section do not apply with
3737 regard to an independent contractor who contracts with a sexually
3838 oriented business solely to perform repair, maintenance, or
3939 construction services at the business.
4040 SECTION 2. Section 102.005(b), Business & Commerce Code, as
4141 effective April 1, 2009, is amended to read as follows:
4242 (b) A sexually oriented business commits an offense if the
4343 business violates Section 102.003 or 102.0031.
4444 SECTION 3. Chapter 102, Business & Commerce Code, as
4545 effective September 1, 2009, is amended by adding Subchapter C to
4646 read as follows:
4747 SUBCHAPTER C. REQUIREMENT TO MAINTAIN CERTAIN RECORDS
4848 Sec. 102.101. DEFINITION. In this subchapter, "sexually
4949 oriented business" has the meaning assigned by Section 243.002,
5050 Local Government Code.
5151 Sec. 102.102. REQUIREMENT TO MAINTAIN PHOTOGRAPHIC
5252 IDENTIFICATION RECORDS. (a) A sexually oriented business shall
5353 maintain at the business a record that contains a copy of a valid
5454 proof of identification of each employee or independent contractor
5555 working at the business.
5656 (b) A proof of identification satisfies the requirements of
5757 Subsection (a) if the identification:
5858 (1) contains a physical description and photograph
5959 consistent with the person's appearance;
6060 (2) contains the date of birth of the person; and
6161 (3) was issued by a government agency.
6262 (c) The form of identification under Subsection (a) may
6363 include:
6464 (1) a driver's license issued by this state or another
6565 state;
6666 (2) a passport; or
6767 (3) an identification card issued by this or another
6868 state or the federal government.
6969 (d) A sexually oriented business shall maintain a record
7070 under this section for at least five years after the date the
7171 employee or independent contractor ends employment with or a
7272 contractual obligation to the business.
7373 (e) The requirements of this section do not apply with
7474 regard to an independent contractor who contracts with a sexually
7575 oriented business solely to perform repair, maintenance, or
7676 construction services at the business.
7777 Sec. 102.103. CRIMINAL PENALTY. (a) A sexually oriented
7878 business commits an offense if the business violates Section
7979 102.102.
8080 (b) An offense under this section is a Class A misdemeanor.
8181 SECTION 4. (a) Sections 1 and 2 of this Act take effect only
8282 if the Act of the 81st Legislature, Regular Session, 2009, relating
8383 to nonsubstantive additions to and corrections in existing codes
8484 does not become law.
8585 (b) Section 3 of this Act takes effect only if the Act of
8686 the 81st Legislature, Regular Session, 2009, relating to
8787 nonsubstantive additions to and corrections in existing codes
8888 becomes law.
8989 SECTION 5. This Act takes effect September 1, 2009.
