9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. Section 548.602(c), Transportation Code, is | |
11 | 11 | amended to read as follows: | |
12 | 12 | (c) It is a defense to prosecution under Subsection (a)(1) | |
13 | 13 | that: | |
14 | 14 | (1) an inspection certificate for the vehicle is in | |
15 | 15 | effect at the time of the arrest; or | |
16 | 16 | (2) the defendant provides to the court a receipt | |
17 | 17 | issued by an inspection station showing that the date of expiration | |
18 | 18 | designated on the inspection certificate issued for the vehicle is | |
19 | 19 | incorrect and that the offense charged was alleged to have occurred | |
20 | 20 | before the fifth day after the correct date of expiration that | |
21 | 21 | should have been designated on the certificate. | |
22 | 22 | SECTION 2. The change in law made by this Act applies to an | |
23 | 23 | offense under Section 548.602(a)(1), Transportation Code, | |
24 | 24 | regardless of whether the offense was committed before, on, or | |
25 | 25 | after the effective date of this Act. | |
26 | 26 | SECTION 3. This Act takes effect September 1, 2009. |
