66 AN ACT
77 relating to a defense to prosecution for the offense of operating a
88 motor vehicle with an expired inspection certificate.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 548.602(c), Transportation Code, is
1111 amended to read as follows:
1212 (c) It is a defense to prosecution under Subsection (a)(1)
1313 that:
1414 (1) an inspection certificate for the vehicle is in
1515 effect at the time of the arrest; or
1616 (2) the defendant provides to the court a receipt
1717 issued by an inspection station showing that the date of expiration
1818 designated on the inspection certificate issued for the vehicle is
1919 incorrect and that the offense charged was alleged to have occurred
2020 before the fifth day after the correct date of expiration that
2121 should have been designated on the certificate.
2222 SECTION 2. The change in law made by this Act applies to an
2323 offense under Section 548.602(a)(1), Transportation Code,
2424 regardless of whether the offense was committed before, on, or
2525 after the effective date of this Act.
2626 SECTION 3. This Act takes effect September 1, 2009.
