8 | 8 | | employee organizations from a state employee's salary. |

9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 10 | | SECTION 1. Section 659.1031, Government Code, is amended to |
---|
11 | 11 | | read as follows: |
---|
12 | 12 | | Sec. 659.1031. DEDUCTION OF MEMBERSHIP FEES FOR ELIGIBLE |
---|
13 | 13 | | [STATE EMPLOYEE] ORGANIZATIONS. (a) An employee of a state agency |
---|
14 | 14 | | may authorize in writing a deduction each pay period from the |
---|
15 | 15 | | employee's salary or wage payment for payment to an eligible [state |
---|
16 | 16 | | employee] organization of a membership fee in the organization. |
---|
17 | 17 | | (b) In this section, "eligible [state employee] |
---|
18 | 18 | | organization" means: |
---|
19 | 19 | | (1) a state employee organization with a membership of |
---|
20 | 20 | | at least 2,000 active or retired state employees who hold or who |
---|
21 | 21 | | have held certification from the Commission on Law Enforcement |
---|
22 | 22 | | Officer Standards and Education; or |
---|
23 | 23 | | (2) a national nonprofit organization with: |
---|
24 | 24 | | (A) a membership of at least 2,000 active or |
---|
25 | 25 | | retired state employees who are employed or have been employed by |
---|
26 | 26 | | the Texas Department of Criminal Justice; and |
---|
27 | 27 | | (B) a primary function of preserving and |
---|
28 | 28 | | supporting the surviving families of correctional officers. |
---|
29 | 29 | | SECTION 2. This Act takes effect immediately if it receives |
---|
30 | 30 | | a vote of two-thirds of all the members elected to each house, as |
---|
31 | 31 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
32 | 32 | | Act does not receive the vote necessary for immediate effect, this |
---|
33 | 33 | | Act takes effect September 1, 2009. |
