66 AN ACT
77 relating to the deduction of membership fees for correctional
88 employee organizations from a state employee's salary.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 659.1031, Government Code, is amended to
1111 read as follows:
1212 Sec. 659.1031. DEDUCTION OF MEMBERSHIP FEES FOR ELIGIBLE
1313 [STATE EMPLOYEE] ORGANIZATIONS. (a) An employee of a state agency
1414 may authorize in writing a deduction each pay period from the
1515 employee's salary or wage payment for payment to an eligible [state
1616 employee] organization of a membership fee in the organization.
1717 (b) In this section, "eligible [state employee]
1818 organization" means:
1919 (1) a state employee organization with a membership of
2020 at least 2,000 active or retired state employees who hold or who
2121 have held certification from the Commission on Law Enforcement
2222 Officer Standards and Education; or
2323 (2) a national nonprofit organization with:
2424 (A) a membership of at least 2,000 active or
2525 retired state employees who are employed or have been employed by
2626 the Texas Department of Criminal Justice; and
2727 (B) a primary function of preserving and
2828 supporting the surviving families of correctional officers.
2929 SECTION 2. This Act takes effect immediately if it receives
3030 a vote of two-thirds of all the members elected to each house, as
3131 provided by Section 39, Article III, Texas Constitution. If this
3232 Act does not receive the vote necessary for immediate effect, this
3333 Act takes effect September 1, 2009.
