9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. Section 601.051, Transportation Code, is amended | |
11 | 11 | to read as follows: | |
12 | 12 | Sec. 601.051. REQUIREMENT OF FINANCIAL RESPONSIBILITY. | |
13 | 13 | (a) A person may not operate a motor vehicle in this state unless | |
14 | 14 | financial responsibility is established for that vehicle through: | |
15 | 15 | (1) a motor vehicle liability insurance policy that | |
16 | 16 | complies with Subchapter D; | |
17 | 17 | (2) a surety bond filed under Section 601.121; | |
18 | 18 | (3) a deposit under Section 601.122; | |
19 | 19 | (4) a deposit under Section 601.123; or | |
20 | 20 | (5) self-insurance under Section 601.124. | |
21 | 21 | (b) A peace officer may not stop or detain a person who is | |
22 | 22 | the operator of a motor vehicle for the sole purpose of determining | |
23 | 23 | whether financial responsibility is established for the vehicle. | |
24 | 24 | SECTION 2. Section 601.053, Transportation Code, is amended | |
25 | 25 | by adding Subsection (c) to read as follows: | |
26 | 26 | (c) A document listed in Subsection (a) that describes a | |
27 | 27 | motor vehicle is sufficient evidence that financial responsibility | |
28 | 28 | is established for that vehicle, regardless of whether the operator | |
29 | 29 | is identified by name in the document. | |
30 | 30 | SECTION 3. This Act takes effect September 1, 2009. |
