7	7	relating to a minimum salary schedule for certain professional

9	9	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
10	10	SECTION 1. Effective September 1, 2009, Section 21.402,
11	11	Education Code, is amended by adding Subsection (c-1) to read as
12	12	follows:
13	13	(c-1) Notwithstanding any other provision of this section,
14	14	the salary factor for purposes of this section for an employee with
15	15	21 or more years of experience is 1.0217.
16	16	SECTION 2. Effective September 1, 2010, Section 21.402,
17	17	Education Code, is amended by adding Subsection (c-1) to read as
18	18	follows:

364	364	each year of experience as a teacher, librarian, counselor, or

366	366	SECTION 31. Section 42.2516, Education Code, is amended by
367	367	adding Subsection (e-1) to read as follows:
368	368	(e-1) The amount of revenue to which a school district is
369	369	entitled under Section 42.2518 is in addition to the amount of
370	370	revenue to which the district is entitled under Subsection (b).
371	371	SECTION 32. Subchapter E, Chapter 42, Education Code, is
372	372	amended by adding Section 42.2518 to read as follows:
373	373	Sec. 42.2518. ADDITIONAL STATE AID FOR EXTENSION OF
374	374	PROFESSIONAL STAFF SALARY SCHEDULE. (a) A school district,
375	375	including a school district that is otherwise ineligible for state
376	376	aid under this chapter, is entitled to state aid in an amount, as
377	377	determined by the commissioner, necessary to compensate the school
378	378	district for additional salary costs the district incurs because of
379	379	the increased number of years covered by the minimum salary
380	380	schedule for certain professional staff made by _.B. No. ___, Acts
381	381	of the 81st Legislature, Regular Session, 2009.
382	382	(b) A district may use state aid received under this section
383	383	only to pay salary costs incurred because of the increased number of
384	384	years covered by the minimum salary schedule.
385	385	(c) A determination by the commissioner under this section
386	386	is final and may not be appealed.
387	387	(d) The commissioner may adopt rules to implement this
388	388	section.
389	389	SECTION 33. A change in law made by this Act does not affect
390	390	a contract between a school district and a person entitled to a
391	391	minimum salary under Section 21.402, Education Code, if the
392	392	contract:
393	393	(1) was entered into before the effective date of the
394	394	change in law made by this Act; and
395	395	(2) provides for a salary greater than the minimum
396	396	salary to which the person would be entitled under Section 21.402,
397	397	Education Code, as amended by this Act.
