9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. Section 12.01, Alcoholic Beverage Code, is | |
11 | 11 | amended by adding Subsection (c) to read as follows: | |
12 | 12 | (c) The holder of a brewer's permit whose premises is | |
13 | 13 | located in an area where the sale of ale and malt liquor is legal and | |
14 | 14 | who produces at least 1,000 barrels of ale or malt liquor a year may | |
15 | 15 | sell ale and malt liquor manufactured or bottled on the permitted | |
16 | 16 | premises to ultimate consumers: | |
17 | 17 | (1) in unbroken packages for off-premises consumption | |
18 | 18 | in an amount that does not exceed 35,000 gallons annually; and | |
19 | 19 | (2) for consumption on the brewery premises if the | |
20 | 20 | brewery is located in an area where the sale of ale and malt liquor | |
21 | 21 | for on-premises consumption is legal. | |
22 | 22 | SECTION 2. This Act takes effect September 1, 2009. |
