55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the sale of ale and malt liquor by brewer's permit
88 holders.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 12.01, Alcoholic Beverage Code, is
1111 amended by adding Subsection (c) to read as follows:
1212 (c) The holder of a brewer's permit whose premises is
1313 located in an area where the sale of ale and malt liquor is legal and
1414 who produces at least 1,000 barrels of ale or malt liquor a year may
1515 sell ale and malt liquor manufactured or bottled on the permitted
1616 premises to ultimate consumers:
1717 (1) in unbroken packages for off-premises consumption
1818 in an amount that does not exceed 35,000 gallons annually; and
1919 (2) for consumption on the brewery premises if the
2020 brewery is located in an area where the sale of ale and malt liquor
2121 for on-premises consumption is legal.
2222 SECTION 2. This Act takes effect September 1, 2009.
