10 | 10 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
11 | 11 | SECTION 1. Section 143.025, Local Government Code, is | |
12 | 12 | amended by amending Subsection (h) and adding Subsection (h-1) to | |
13 | 13 | read as follows: | |
14 | 14 | (h) Except as provided by Subsection (h-1), the [The] | |
15 | 15 | commission shall keep each eligibility list for a beginning | |
16 | 16 | position in effect for a period of not less than six months or more | |
17 | 17 | than 12 months, unless the names of all applicants on the list have | |
18 | 18 | been referred to the appropriate department. The commission shall | |
19 | 19 | determine the length of the period. The commission shall give new | |
20 | 20 | examinations at times the commission considers necessary to provide | |
21 | 21 | required staffing for scheduled fire or police training academies. | |
22 | 22 | (h-1) Notwithstanding Subsection (h), in a municipality | |
23 | 23 | with a population of 1.2 million or more that is not generally | |
24 | 24 | subject to Subchapter G, the commission may keep an eligibility | |
25 | 25 | list for a beginning position in the fire department in effect for a | |
26 | 26 | period not to exceed 24 months. | |
27 | 27 | SECTION 2. This Act takes effect September 1, 2009. |
