66 AN ACT
77 relating to the length of time an eligibility list remains in effect
88 for beginning positions in a fire department in certain
99 municipalities under municipal civil service.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 143.025, Local Government Code, is
1212 amended by amending Subsection (h) and adding Subsection (h-1) to
1313 read as follows:
1414 (h) Except as provided by Subsection (h-1), the [The]
1515 commission shall keep each eligibility list for a beginning
1616 position in effect for a period of not less than six months or more
1717 than 12 months, unless the names of all applicants on the list have
1818 been referred to the appropriate department. The commission shall
1919 determine the length of the period. The commission shall give new
2020 examinations at times the commission considers necessary to provide
2121 required staffing for scheduled fire or police training academies.
2222 (h-1) Notwithstanding Subsection (h), in a municipality
2323 with a population of 1.2 million or more that is not generally
2424 subject to Subchapter G, the commission may keep an eligibility
2525 list for a beginning position in the fire department in effect for a
2626 period not to exceed 24 months.
2727 SECTION 2. This Act takes effect September 1, 2009.
