55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the creation of the offense of obstruction of or
88 retaliation against a process server.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Sections 36.06(a) and (b), Penal Code, are
1111 amended to read as follows:
1212 (a) A person commits an offense if he intentionally or
1313 knowingly harms or threatens to harm another by an unlawful act:
1414 (1) in retaliation for or on account of the service or
1515 status of another as a:
1616 (A) public servant, process server, witness,
1717 prospective witness, or informant; or
1818 (B) person who has reported or who the actor
1919 knows intends to report the occurrence of a crime; or
2020 (2) to prevent or delay the service of another as a:
2121 (A) public servant, process server, witness,
2222 prospective witness, or informant; or
2323 (B) person who has reported or who the actor
2424 knows intends to report the occurrence of a crime.
2525 (b) In this section:
2626 (1) "Civil process" means all process issued or
2727 sanctioned by a civil court.
2828 (2) "Honorably retired peace officer" means a peace
2929 officer who:
3030 (A) did not retire in lieu of any disciplinary
3131 action;
3232 (B) was eligible to retire from a law enforcement
3333 agency or was ineligible to retire only as a result of an injury
3434 received in the course of the officer's employment with the agency;
3535 and
3636 (C) is entitled to receive a pension or annuity
3737 for service as a law enforcement officer or is not entitled to
3838 receive a pension or annuity only because the law enforcement
3939 agency that employed the officer does not offer a pension or annuity
4040 to its employees.
4141 (3) [(2)] "Informant" means a person who has
4242 communicated information to the government in connection with any
4343 governmental function.
4444 (4) "Process server" means a person who serves civil
4545 process.
4646 (5) [(3)] "Public servant" includes an honorably
4747 retired peace officer.
4848 SECTION 2. This Act takes effect September 1, 2009.
