8 | 8 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
9 | 9 | SECTION 1. Section 154.021, Civil Practice and Remedies | |
10 | 10 | Code, is amended by adding Subsection (c) to read as follows: | |
11 | 11 | (c) Except as provided by agreement of the parties, a court | |
12 | 12 | may not order mediation in an action that is subject to the Federal | |
13 | 13 | Arbitration Act (9 U.S.C. Sections 1-16). | |
14 | 14 | SECTION 2. The change in law made by this Act applies only | |
15 | 15 | to an action that is commenced on or after the effective date of | |
16 | 16 | this Act. An action that is commenced before the effective date of | |
17 | 17 | this Act is governed by the law as it existed immediately before | |
18 | 18 | that date, and that law is continued in effect for that purpose. | |
19 | 19 | SECTION 3. This Act takes effect immediately if it receives | |
20 | 20 | a vote of two-thirds of all the members elected to each house, as | |
21 | 21 | provided by Section 39, Article III, Texas Constitution. If this | |
22 | 22 | Act does not receive the vote necessary for immediate effect, this | |
23 | 23 | Act takes effect September 1, 2009. |
