55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the prosecution and punishment of the offense of
88 criminal trespass.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 30.05(a), Penal Code, is amended to read
1111 as follows:
1212 (a) A person commits an offense if the person [he] enters or
1313 remains on or in property of another, including residential land,
1414 agricultural land, a recreational vehicle park, a building, or an
1515 aircraft or other vehicle, [of another] without effective consent
1616 [or he enters or remains in a building of another without effective
1717 consent] and the person [he]:
1818 (1) had notice that the entry was forbidden; or
1919 (2) received notice to depart but failed to do so.
2020 SECTION 2. Section 30.05(b), Penal Code, is amended by
2121 adding Subdivisions (8), (9), and (10) to read as follows:
2222 (8) "Recognized state" means another state with which
2323 the attorney general of this state, with the approval of the
2424 governor of this state, negotiated an agreement after determining
2525 that the other state:
2626 (A) has firearm proficiency requirements for
2727 peace officers; and
2828 (B) fully recognizes the right of peace officers
2929 commissioned in this state to carry weapons in the other state.
3030 (9) "Recreational vehicle park" means a tract of land
3131 that has rental spaces for two or more recreational vehicles, as
3232 defined by Section 522.004, Transportation Code.
3333 (10) "Residential land" means real property improved
3434 by a dwelling and zoned for or otherwise authorized for
3535 single-family or multifamily use.
3636 SECTION 3. Sections 30.05(d) and (e), Penal Code, are
3737 amended to read as follows:
3838 (d) An offense under this section [Subsection (e) is a Class
3939 C misdemeanor unless it is committed in a habitation or unless the
4040 actor carries a deadly weapon on or about the actor's person during
4141 the commission of the offense, in which event it is a Class A
4242 misdemeanor. An offense under Subsection (a)] is a Class C [B]
4343 misdemeanor, except that the offense is:
4444 (1) a Class B misdemeanor if it is shown on the trial
4545 of the offense that the defendant has been previously convicted of
4646 an offense under this section; and
4747 (2) a Class A misdemeanor if:
4848 (A) [(1)] the offense is committed:
4949 (i) [(A)] in a habitation or a shelter
5050 center;
5151 (ii) [(B)] on a Superfund site; or
5252 (iii) [(C)] on or in a critical
5353 infrastructure facility; or
5454 (B) [(2)] the person [actor] carries a deadly
5555 weapon [on or about his person] during the commission of the
5656 offense.
5757 (e) It is a defense to prosecution under this section that
5858 the actor at the time of the offense was [A person commits an
5959 offense if without express consent or if without authorization
6060 provided by any law, whether in writing or other form, the person]:
6161 (1) a firefighter or emergency medical services
6262 personnel, as defined by Section 773.003, Health and Safety Code,
6363 acting in the lawful discharge of an official duty under exigent
6464 circumstances [enters or remains on agricultural land of another];
6565 or
6666 (2) a person who was:
6767 (A) employed by or acting as agent for an entity,
6868 including an electric utility, as defined by Section 31.002,
6969 Utilities Code, or a gas utility, as defined by Section 101.003 or
7070 121.001, Utilities Code, that had, or that the person reasonably
7171 believed had, effective consent or authorization provided by law to
7272 enter the property; and
7373 (B) performing a duty within the scope of that
7474 employment or agency [is on the agricultural land and within 100
7575 feet of the boundary of the land when apprehended; and
7676 [(3) had notice that the entry was forbidden or
7777 received notice to depart but failed to do so].
7878 SECTION 4. Sections 30.05(c) and (j), Penal Code, are
7979 repealed.
8080 SECTION 5. The change in law made by this Act applies only
8181 to an offense committed on or after the effective date of this Act.
8282 An offense committed before the effective date of this Act is
8383 covered by the law in effect when the offense was committed, and the
8484 former law is continued in effect for that purpose. For purposes of
8585 this section, an offense was committed before the effective date of
8686 this Act if any element of the offense was committed before that
8787 date.
8888 SECTION 6. This Act takes effect September 1, 2009.
