1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subtitle I, Title 6, Special District Local Laws
1313 Code, is amended by adding Chapter 9032 to read as follows:
1414 CHAPTER 9032. OAK POINT WATER CONTROL AND IMPROVEMENT
1515 DISTRICT NO. 4 OF DENTON COUNTY
1616 SUBCHAPTER A. GENERAL PROVISIONS
1717 Sec. 9032.001. DEFINITION. In this chapter, "district"
1818 means the Oak Point Water Control and Improvement District No. 4 of
1919 Denton County.

2121 SUBCHAPTER B. POWERS AND DUTIES
2222 Sec. 9032.051. WATER CONTROL AND IMPROVEMENT DISTRICT
2323 POWERS AND DUTIES. The district has the powers and duties provided
2424 by the general law of this state, including Chapters 49 and 51,
2525 Water Code, applicable to water control and improvement districts
2626 created under Section 59, Article XVI, Texas Constitution.
2727 Sec. 9032.052. AUTHORITY FOR ROAD PROJECTS. Under Section
2828 52, Article III, Texas Constitution, the district may design,
2929 acquire, construct, finance, issue bonds for, improve, operate,
3030 maintain and convey to this state, a county, or a municipality for
3131 operation and maintenance macadamized, graveled, or paved roads, or
3232 improvements, including storm drainage, in aid of those roads.
3333 Sec. 9032.053. ROAD STANDARDS AND REQUIREMENTS. (a) A road
3434 project must meet all applicable construction standards, zoning and
3535 subdivision requirements, and regulations of each municipality in
3636 whose corporate limits or extraterritorial jurisdiction the road
3737 project is located.
3838 (b) If a road project is not located in the corporate limits
3939 or extraterritorial jurisdiction of a municipality, the road
4040 project must meet all applicable construction standards,
4141 subdivision requirements, and regulations of each county in which
4242 the road project is located.
4343 (c) If the state will maintain and operate the road, the
4444 Texas Transportation Commission must approve the plans and
4545 specifications of the road project.
4646 Sec. 9032.054. COMPLIANCE WITH MUNICIPAL CONSENT ORDINANCE
4747 OR RESOLUTION. The district shall comply with all applicable
4848 requirements of an ordinance or resolution by which the governing
4949 body of a municipality consents to the creation of the district or
5050 to the inclusion of land in the district, including an ordinance or
5151 resolution adopted before the effective date of this chapter.
5252 Sec. 9032.055. LIMITATION ON USE OF EMINENT DOMAIN. The
5353 district may not exercise the power of eminent domain outside the
5454 district to acquire a site or easement for:
5555 (1) a road project authorized by Section 9032.052; or
5656 (2) a recreational facility as defined by Section
5757 49.462, Water Code.

5959 SUBCHAPTER C. GENERAL FINANCIAL PROVISIONS
6060 Sec. 9032.101. TAX TO REPAY BONDS. The district may impose
6161 a tax to pay the principal of or interest on bonds issued under
6262 Section 9032.151.

6464 SUBCHAPTER D. BONDS AND OTHER OBLIGATIONS
6565 Sec. 9032.151. AUTHORITY TO ISSUE BONDS AND OTHER
6666 OBLIGATIONS. The district may issue bonds or other obligations
6767 payable wholly or partly from ad valorem taxes, impact fees,
6868 revenue, contract payments, grants, or other district money, or any
6969 combination of those sources, to pay for any authorized district
7070 purpose.
7171 Sec. 9032.152. TAXES FOR BONDS. At the time the district
7272 issues bonds payable wholly or partly from ad valorem taxes, the
7373 district shall provide for the annual imposition of a continuing
7474 direct ad valorem tax, without limit as to rate or amount, while all
7575 or part of the bonds are outstanding.
7676 Sec. 9032.153. BONDS FOR ROAD PROJECTS. (a) The district
7777 may not issue bonds payable from ad valorem taxes to finance a road
7878 project unless the issuance is approved by a vote of a two-thirds
7979 majority of the district voters voting at an election held for that
8080 purpose.
8181 (b) At the time of issuance, the total principal amount of
8282 bonds or other obligations issued or incurred to finance road
8383 projects and payable from ad valorem taxes may not exceed
8484 one-fourth of the assessed value of the real property in the
8585 district.
8686 SECTION 2. (a) The legal notice of the intention to
8787 introduce this Act, setting forth the general substance of this
8888 Act, has been published as provided by law, and the notice and a
8989 copy of this Act have been furnished to all persons, agencies,
9090 officials, or entities to which they are required to be furnished
9191 under Section 59, Article XVI, Texas Constitution, and Chapter 313,
9292 Government Code.
9393 (b) The governor, one of the required recipients, has
9494 submitted the notice and Act to the Texas Commission on
9595 Environmental Quality.
9696 (c) The Texas Commission on Environmental Quality has filed
9797 its recommendations relating to this Act with the governor, the
9898 lieutenant governor, and the speaker of the house of
9999 representatives within the required time.
100100 (d) All requirements of the constitution and laws of this
101101 state and the rules and procedures of the legislature with respect
102102 to the notice, introduction, and passage of this Act are fulfilled
103103 and accomplished.
104104 SECTION 3. This Act takes effect immediately if it receives
105105 a vote of two-thirds of all the members elected to each house, as
106106 provided by Section 39, Article III, Texas Constitution. If this
107107 Act does not receive the vote necessary for immediate effect, this
108108 Act takes effect September 1, 2009.
