55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to requiring that a driver's license, personal
88 identification certificate, commercial driver's license, and
99 commercial driver learner's permit issued by the Department of
1010 Public Safety to a registered sex offender state that the holder is
1111 a registered sex offender.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Section 521.103, Transportation Code, is amended
1414 by adding Subsections (c), (d), and (e) to read as follows:
1515 (c) If the department issues or renews a personal
1616 identification certificate under this section to a person who is
1717 subject to Chapter 62, Code of Criminal Procedure, as a result of a
1818 reportable conviction or adjudication that is based on an offense
1919 or conduct the victim of which was younger than 14 years of age at
2020 the time the offense was committed or the conduct was engaged in,
2121 the department shall print "RSO" in black on the reverse side of
2222 each personal identification certificate issued to or renewed by
2323 the person before the 20th anniversary of the date that the person
2424 was first required to register under Chapter 62, Code of Criminal
2525 Procedure.
2626 (d) The department may collect an additional fee to
2727 implement the requirements of Subsection (c).
2828 (e) The department shall post information on the
2929 department's Internet website explaining that a person whose
3030 personal identification certificate has "RSO" on the certificate is
3131 subject to the registration requirements of Chapter 62, Code of
3232 Criminal Procedure, as a result of a reportable conviction or
3333 adjudication that is based on an offense or conduct the victim of
3434 which was younger than 14 years of age at the time the offense was
3535 committed or the conduct was engaged in.
3636 SECTION 2. Section 521.272, Transportation Code, is amended
3737 by adding Subsections (d), (e), and (f) to read as follows:
3838 (d) If the department issues or renews a driver's license
3939 under this section to a person who is subject to Chapter 62, Code of
4040 Criminal Procedure, as a result of a reportable conviction or
4141 adjudication that is based on an offense or conduct the victim of
4242 which was younger than 14 years of age at the time the offense was
4343 committed or the conduct was engaged in, the department shall print
4444 "RSO" in black on the reverse side of each driver's license issued
4545 to or renewed by the person before the 20th anniversary of the date
4646 that the person was first required to register under Chapter 62,
4747 Code of Criminal Procedure.
4848 (e) The department may collect an additional fee to
4949 implement the requirements of Subsection (d).
5050 (f) The department shall post information on the
5151 department's Internet website explaining that a person whose
5252 driver's license has "RSO" on the license is subject to the
5353 registration requirements of Chapter 62, Code of Criminal
5454 Procedure, as a result of a reportable conviction or adjudication
5555 that is based on an offense or conduct the victim of which was
5656 younger than 14 years of age at the time the offense was committed
5757 or the conduct was engaged in.
5858 SECTION 3. Section 522.033, Transportation Code, is amended
5959 by adding Subsections (c), (d), and (e) to read as follows:
6060 (c) If the department issues or renews a commercial driver's
6161 license or commercial driver learner's permit under this section to
6262 a person who is subject to Chapter 62, Code of Criminal Procedure,
6363 as a result of a reportable conviction or adjudication that is based
6464 on an offense or conduct the victim of which was younger than 14
6565 years of age at the time the offense was committed or the conduct
6666 was engaged in, the department shall print "RSO" in black on the
6767 reverse side of each license or learner's permit issued to or
6868 renewed by the person before the 20th anniversary of the date that
6969 the person was first required to register under Chapter 62, Code of
7070 Criminal Procedure.
7171 (d) The department may collect an additional fee to
7272 implement the requirements of Subsection (c).
7373 (e) The department shall post information on the
7474 department's Internet website explaining that a person whose
7575 commercial driver's license or commercial driver learner's permit
7676 has "RSO" on the license or learner's permit is subject to the
7777 registration requirements of Chapter 62, Code of Criminal
7878 Procedure, as a result of a reportable conviction or adjudication
7979 that is based on an offense or conduct the victim of which was
8080 younger than 14 years of age at the time the offense was committed
8181 or the conduct was engaged in.
8282 SECTION 4. The change in law made by this Act applies only
8383 to a personal identification certificate, driver's license,
8484 commercial driver's license, or commercial driver learner's permit
8585 issued or renewed on or after the effective date of this Act.
8686 SECTION 5. This Act takes effect September 1, 2009.
