6	6	AN ACT
7	7	relating to requiring that a driver's license, personal
8	8	identification certificate, commercial driver's license, and
9	9	commercial driver learner's permit issued by the Department of
10	10	Public Safety to a registered sex offender state that the holder is
11	11	a registered sex offender.
12	12	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
13	13	SECTION 1. Section 521.103, Transportation Code, is amended
14	14	by adding Subsections (c), (d), and (e) to read as follows:
15	15	(c) If the department issues or renews a personal
16	16	identification certificate under this section to a person who is
17	17	subject to Chapter 62, Code of Criminal Procedure, as a result of a
18	18	reportable conviction or adjudication that is based on an offense
19	19	or conduct the victim of which was younger than 14 years of age at
20	20	the time the offense was committed or the conduct was engaged in,
21	21	the department shall print "RSO" in black on the reverse side of
22	22	each personal identification certificate issued to or renewed by
23	23	the person before the 20th anniversary of the date that the person
24	24	was first required to register under Chapter 62, Code of Criminal
25	25	Procedure.
26	26	(d) The department may collect an additional fee to
27	27	implement the requirements of Subsection (c).
28	28	(e) The department shall post information on the
29	29	department's Internet website explaining that a person whose
30	30	personal identification certificate has "RSO" on the certificate is
31	31	subject to the registration requirements of Chapter 62, Code of
32	32	Criminal Procedure, as a result of a reportable conviction or
33	33	adjudication that is based on an offense or conduct the victim of
34	34	which was younger than 14 years of age at the time the offense was
35	35	committed or the conduct was engaged in.
36	36	SECTION 2. Section 521.272, Transportation Code, is amended
37	37	by adding Subsections (d), (e), and (f) to read as follows:
38	38	(d) If the department issues or renews a driver's license
39	39	under this section to a person who is subject to Chapter 62, Code of
40	40	Criminal Procedure, as a result of a reportable conviction or
41	41	adjudication that is based on an offense or conduct the victim of
42	42	which was younger than 14 years of age at the time the offense was
43	43	committed or the conduct was engaged in, the department shall print
44	44	"RSO" in black on the reverse side of each driver's license issued
45	45	to or renewed by the person before the 20th anniversary of the date
46	46	that the person was first required to register under Chapter 62,
47	47	Code of Criminal Procedure.
48	48	(e) The department may collect an additional fee to
49	49	implement the requirements of Subsection (d).
50	50	(f) The department shall post information on the
51	51	department's Internet website explaining that a person whose
52	52	driver's license has "RSO" on the license is subject to the
53	53	registration requirements of Chapter 62, Code of Criminal
54	54	Procedure, as a result of a reportable conviction or adjudication
55	55	that is based on an offense or conduct the victim of which was
56	56	younger than 14 years of age at the time the offense was committed
57	57	or the conduct was engaged in.
58	58	SECTION 3. Section 522.033, Transportation Code, is amended
59	59	by adding Subsections (c), (d), and (e) to read as follows:
60	60	(c) If the department issues or renews a commercial driver's
61	61	license or commercial driver learner's permit under this section to
62	62	a person who is subject to Chapter 62, Code of Criminal Procedure,
63	63	as a result of a reportable conviction or adjudication that is based
64	64	on an offense or conduct the victim of which was younger than 14
65	65	years of age at the time the offense was committed or the conduct
66	66	was engaged in, the department shall print "RSO" in black on the
67	67	reverse side of each license or learner's permit issued to or
68	68	renewed by the person before the 20th anniversary of the date that
69	69	the person was first required to register under Chapter 62, Code of
70	70	Criminal Procedure.
71	71	(d) The department may collect an additional fee to
72	72	implement the requirements of Subsection (c).
73	73	(e) The department shall post information on the
74	74	department's Internet website explaining that a person whose
75	75	commercial driver's license or commercial driver learner's permit
76	76	has "RSO" on the license or learner's permit is subject to the
77	77	registration requirements of Chapter 62, Code of Criminal
78	78	Procedure, as a result of a reportable conviction or adjudication
79	79	that is based on an offense or conduct the victim of which was
80	80	younger than 14 years of age at the time the offense was committed
81	81	or the conduct was engaged in.
82	82	SECTION 4. The change in law made by this Act applies only
83	83	to a personal identification certificate, driver's license,
84	84	commercial driver's license, or commercial driver learner's permit
85	85	issued or renewed on or after the effective date of this Act.
86	86	SECTION 5. This Act takes effect September 1, 2009.
