77 relating to establishing a health science center and medical school
88 in the Rio Grande Valley.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter L, Chapter 74, Education Code, is
1111 amended to read as follows:
1212 SUBCHAPTER L. THE UNIVERSITY OF TEXAS HEALTH SCIENCE
1313 CENTER-- [LOWER] RIO GRANDE VALLEY [ACADEMIC HEALTH CENTER]
1414 Sec. 74.611. HEALTH SCIENCE [AUTHORITY TO ESTABLISH OR
1515 PARTICIPATE IN] CENTER. (a) The board of regents of The University
1616 of Texas System shall operate The University of Texas Health
1717 Science Center--Rio Grande Valley as a component institution of The
1818 University of Texas System with its main campus and administrative
1919 offices located in the Rio Grande Valley. The health science center
2020 consists of a medical school, other health and health-related
2121 degree programs, and related programs and facilities as the board
2222 considers appropriate.
2323 (b) The board of regents may include facilities located in
2424 [may establish a regional academic health center serving] Cameron,
2525 Hidalgo, Starr, and Willacy Counties in the health science center
2626 [counties,] and may operate programs and activities and provide
2727 related services of the center [include any medical institutions
2828 for participation in the program] in those [the aforementioned]
2929 counties [, if general revenue funds are specifically appropriated
3030 by the legislature for that purpose. The center may consist of
3131 facilities located throughout the region].
3232 Sec. 74.612. PARTICIPATION IN AVAILABLE UNIVERSITY FUND.
3333 In accordance with Section 18(c), Article VII, Texas Constitution,
3434 if the Act enacting this section receives a vote of two-thirds of
3535 all the members elected to each house of the legislature, the
3636 institution created by this section is entitled to participate in
3737 the funding provided by Section 18, Article VII, Texas
3838 Constitution, for The University of Texas System.
3939 Sec. 74.613. COURSES AND DEGREES; RULES. The board of
4040 regents may prescribe courses leading to customary degrees and may
4141 adopt rules for the operation, control, and management of the
4242 health science center as may be necessary for the conduct of a
4343 medical school and other health science center programs of the
4444 first class.
4545 Sec. 74.614. AFFILIATION AGREEMENTS; JOINT APPOINTMENTS.
4646 (a) The board of regents may execute and carry out affiliation or
4747 coordination agreements with any other entity or institution in the
4848 region to [establish or to] participate in the health science
4949 center [establishment or operation of the center, which includes
5050 all traditional and all other providers of health services to the
5151 counties listed in this subsection].
5252 (b) The board of regents may make joint appointments in the
5353 health science center and other institutions under the board's
5454 governance. The salary of a person who receives a joint appointment
5555 shall be apportioned to the appointing institutions on the basis of
5656 services rendered.
5757 [(b) The board of regents may assign responsibility for the
5858 management of the regional academic health center to any component
5959 institution or institutions of The University of Texas System. The
6060 operating costs of the regional academic health center shall be
6161 paid from operating funds of the component institution and from
6262 available funds of any other public or private entity.
6363 [(c) The regional academic health center may be used to
6464 provide undergraduate clinical education, graduate education,
6565 including residency training programs, or other levels of medical
6666 education work in the counties identified in Subsection (a) in
6767 connection with any component institution or institutions of The
6868 University of Texas System as the board of regents determines
6969 appropriate.]
7070 Sec. 74.615 [74.612]. GIFTS AND GRANTS. The board of
7171 regents may accept and administer gifts and grants from any public
7272 or private person or entity for the use and benefit of the [regional
7373 academic] health science center.
7474 Sec. 74.616 [74.613]. OTHER FACILITIES. In addition to the
7575 facilities of the health science center, the board of regents may
7676 enter into agreements under which additional [The physical]
7777 facilities [of the regional academic health center] used in the
7878 center's [its] teaching and research programs, including
7979 libraries, auditoriums, research facilities, and medical education
8080 buildings, may be provided by a public or private entity. [A
8181 physical facility may be constructed, maintained, or operated with
8282 state money appropriated for that purpose.]
8383 Sec. 74.617 [74.614]. TEACHING HOSPITAL. A teaching
8484 hospital considered suitable by the board of regents for the health
8585 science center may be provided by a public or private entity. The
8686 hospital may not be constructed, maintained, or operated with state
8787 funds.
8888 Sec. 74.618 [74.615]. COORDINATING BOARD SUPERVISION. The
8989 [regional academic] health science center is subject to the
9090 continuing supervision of the Texas Higher Education Coordinating
9191 Board under Chapter 61 and to the rules of the coordinating board
9292 adopted under Chapter 61.
9393 SECTION 2. Section 55.1732, Education Code, is amended by
9494 adding Subsection (e) to read as follows:
9595 (e) Bonds authorized or issued under this section for the
9696 regional academic health center established under Section 74.611
9797 are considered to have been authorized or issued for The University
9898 of Texas Health Science Center--Rio Grande Valley when that
9999 institution is established.
100100 SECTION 3. Section 61.003(5), Education Code, is amended to
101101 read as follows:
102102 (5) "Medical and dental unit" means The University of
103103 Texas Medical Branch at Galveston; The University of Texas
104104 Southwestern Medical Center at Dallas; The University of Texas
105105 Medical School at San Antonio; The University of Texas Dental
106106 Branch at Houston; The University of Texas M.D. Anderson Cancer
107107 Center; The University of Texas Graduate School of Biomedical
108108 Sciences at Houston; The University of Texas Dental School at San
109109 Antonio; The University of Texas Medical School at Houston; The
110110 University of Texas Health Science Center--Rio Grande Valley; the
111111 nursing institutions of The University of Texas System; and The
112112 University of Texas School of Public Health at Houston; and such
113113 other medical or dental schools as may be established by statute or
114114 as provided in this chapter.
115115 SECTION 4. Section 63.002(c), Education Code, is amended to
116116 read as follows:
117117 (c) The amount available for distribution from the fund may
118118 be appropriated only for programs that benefit medical research,
119119 health education, or treatment programs at the following
120120 health-related institutions of higher education:
121121 (1) The University of Texas Health Science Center at
122122 San Antonio;
123123 (2) The University of Texas M. D. Anderson Cancer
124124 Center;
125125 (3) The University of Texas Southwestern Medical
126126 Center at Dallas;
127127 (4) The University of Texas Medical Branch at
128128 Galveston;
129129 (5) The University of Texas Health Science Center at
130130 Houston;
131131 (6) The University of Texas Health Science Center at
132132 Tyler;
133133 (7) The University of Texas Health Science Center--Rio
134134 Grande Valley;
135135 (8) The Texas A&M University Health Science Center;
136136 (9) [(8)] the University of North Texas Health Science
137137 Center at Fort Worth;
138138 (10) [(9)] the Texas Tech University Health Sciences
139139 Center; and
140140 (11) [(10)] Baylor College of Medicine, if a contract
141141 between Baylor College of Medicine and the Texas Higher Education
142142 Coordinating Board is in effect under Section 61.092.
143143 SECTION 5. Section 63.101(a), Education Code, is amended to
144144 read as follows:
145145 (a) A separate permanent endowment fund is established for
146146 the benefit of each of the following institutions of higher
147147 education:
148148 (1) The University of Texas Health Science Center at
149149 San Antonio;
150150 (2) The University of Texas M. D. Anderson Cancer
151151 Center;
152152 (3) The University of Texas Southwestern Medical
153153 Center at Dallas;
154154 (4) The University of Texas Medical Branch at
155155 Galveston;
156156 (5) The University of Texas Health Science Center at
157157 Houston;
158158 (6) The University of Texas Health Science Center at
159159 Tyler;
160160 (7) The University of Texas at El Paso;
161161 (8) The Texas A&M University Health Science Center;
162162 (9) the University of North Texas Health Science
163163 Center at Fort Worth;
164164 (10) the components of the Texas Tech University
165165 Health Sciences Center located in El Paso;
166166 (11) the components of the Texas Tech University
167167 Health Sciences Center at locations other than El Paso;
168168 (12) The University of Texas Health Science
169169 Center--Rio Grande Valley [the regional academic health center
170170 established under Section 74.611]; and
171171 (13) Baylor College of Medicine, if a contract between
172172 Baylor College of Medicine and the Texas Higher Education
173173 Coordinating Board is in effect under Section 61.092.
174174 SECTION 6. Section 65.02(a), Education Code, is amended to
175175 read as follows:
176176 (a) The University of Texas System is composed of the

256256 SECTION 7. (a) The board of regents of The University of
257257 Texas System shall convert the regional academic health center
258258 established under Subchapter L, Chapter 74, Education Code, as that
259259 subchapter existed before the effective date of this Act, into The
260260 University of Texas Health Science Center--Rio Grande Valley and
261261 establish a medical school at the health science center after this
262262 Act takes effect as soon as the board considers appropriate
263263 considering available resources and the best interests of The
264264 University of Texas System and the people of this state and the
265265 Lower Rio Grande Valley, but not later than the 2011-2012 academic
266266 year. In establishing the health science center and medical
267267 school, the board of regents shall ensure that the existing
268268 programs, students, and faculty and staff of the regional academic
269269 health center are not affected other than as the board considers
270270 necessary to implement this Act.
271271 (b) It is the intent of the legislature that The University
272272 of Texas Health Science Center--Rio Grande Valley be established by
273273 conversion of the regional academic health center established under
274274 Subchapter L, Chapter 74, Education Code, as that subchapter
275275 existed before the effective date of this Act, and that those
276276 entities be considered to be the same institution. A reference in
277277 law to the regional academic health center applies to The
278278 University of Texas Health Science Center--Rio Grande Valley to the
279279 extent it can be made applicable. All contracts and agreements,
280280 including bonds and other financial obligations, entered into by
281281 The University of Texas System or any of its officers or employees
282282 relating to the regional academic health center apply to The
283283 University of Texas Health Science Center--Rio Grande Valley when
284284 the health science center is established.
285285 (c) The permanent endowment fund established under Section
286286 63.101, Education Code, for the benefit of the regional academic
287287 health center established under Subchapter L, Chapter 74, Education
288288 Code, as that subchapter existed before the effective date of this
289289 Act, is transferred to the benefit of The University of Texas Health
290290 Science Center--Rio Grande Valley when the health science center is
291291 established. It is the intent of the legislature that the transfer
292292 of the endowment fund be made so as not to interrupt the research or
293293 other programs supported by distributions from the fund.
294294 SECTION 8. This Act takes effect immediately if it receives
295295 a vote of two-thirds of all the members elected to each house, as
296296 provided by Section 39, Article III, Texas Constitution. If this
297297 Act does not receive the vote necessary for immediate effect, this
298298 Act takes effect September 1, 2009.
