66 relating to the use of direct recording electronic voting machines.
77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Chapter 129, Election Code, is amended by adding
99 Section 129.002 to read as follows:
1010 Sec. 129.002. PAPER AUDIT TRAIL REQUIRED. (a) A voting
1111 system that consists of direct recording electronic voting machines
1212 may not be used in an election unless the system:
1313 (1) has:
1414 (A) been certified or otherwise approved by means
1515 of qualification testing by a nationally recognized test
1616 laboratory; and
1717 (B) met or exceeded the minimum requirements
1818 contained in "Performance and Test Standards for Punch Card, Mark
1919 Sense, and Direct Recording Electronic Voting Systems" or a
2020 successor voluntary standards document developed and adopted by the
2121 Federal Election Commission, the Election Assistance Commission,
2222 or the National Institute of Standards and Technology; and
2323 (2) creates a contemporaneous auditable paper record
2424 copy of each electronic ballot that allows a voter to confirm the
2525 choices the voter made through both a visual and a nonvisual method,
2626 such as through an audio component, before the voter casts the
2727 ballot.
2828 (b) The paper record copy must list the contests on the
2929 ballot and the voter's choices in those contests. The paper record
3030 copy is not a ballot.
3131 SECTION 2. This Act takes effect January 1, 2008.
