| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 1369.153, Insurance Code, is amended to |
|---|
| 11 | 11 | | read as follows: |
|---|
| 12 | 12 | | Sec. 1369.153. INFORMATION REQUIRED ON IDENTIFICATION |
|---|
| 13 | 13 | | CARD. (a) An issuer of a health benefit plan that provides |
|---|
| 14 | 14 | | pharmacy benefits to enrollees shall include on the front of the |
|---|
| 15 | 15 | | identification card of each enrollee: |
|---|
| 16 | 16 | | (1) the name or logo of the entity administering the |
|---|
| 17 | 17 | | pharmacy benefits if the entity is different from the health |
|---|
| 18 | 18 | | benefit plan issuer; |
|---|
| 19 | 19 | | (2) the group number applicable to the enrollee; |
|---|
| 20 | 20 | | (3) the identification number of the enrollee, which |
|---|
| 21 | 21 | | may not be the enrollee's social security number; |
|---|
| 22 | 22 | | (4) the bank identification number necessary for |
|---|
| 23 | 23 | | electronic billing; |
|---|
| 24 | 24 | | (5) [(3)] the effective date and expected expiration |
|---|
| 25 | 25 | | date of the coverage evidenced by the card; |
|---|
| 26 | 26 | | (6) [(4)] a telephone number for contacting an |
|---|
| 27 | 27 | | appropriate person to obtain information relating to the pharmacy |
|---|
| 28 | 28 | | benefits provided under the plan; and |
|---|
| 29 | 29 | | (7) [(5)] copayment and deductible information for |
|---|
| 30 | 30 | | generic and brand-name prescription drugs. |
|---|
| 31 | 31 | | (b) In addition to complying with Subsection (a), an issuer |
|---|
| 32 | 32 | | of a health benefit plan may provide the information required under |
|---|
| 33 | 33 | | Subsection (a) in electronically readable form on the back of the |
|---|
| 34 | 34 | | identification card. |
|---|
| 35 | 35 | | (c) This section does not require a health benefit plan |
|---|
| 36 | 36 | | issuer that administers its own pharmacy benefits to issue an |
|---|
| 37 | 37 | | identification card separate from any identification card issued to |
|---|
| 38 | 38 | | an enrollee to evidence coverage under the plan if the |
|---|
| 39 | 39 | | identification card issued to evidence coverage contains the |
|---|
| 40 | 40 | | information required by Subsection (a). |
|---|
| 41 | 41 | | SECTION 2. This Act applies only to an insurance policy or |
|---|
| 42 | 42 | | contract or evidence of coverage that is delivered, issued for |
|---|
| 43 | 43 | | delivery, or renewed on or after January 1, 2010. An insurance |
|---|
| 44 | 44 | | policy or contract or evidence of coverage delivered, issued for |
|---|
| 45 | 45 | | delivery, or renewed before January 1, 2010, is governed by the law |
|---|
| 46 | 46 | | as it existed immediately before the effective date of this Act, and |
|---|
| 47 | 47 | | that law is continued in effect for that purpose. |
|---|
| 48 | 48 | | SECTION 3. This Act takes effect September 1, 2009. |
