55 relating to the hours worked during a week by firefighters in
66 certain municipalities.
77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Section 142.0015, Local Government Code, is
99 amended by adding Subsection (e-1) to read as follows:
1010 (e-1) Notwithstanding Subsection (d), in a municipality
1111 with a population of one million or more that has not adopted
1212 Chapter 143, for purposes of determining hours worked, including
1313 determining hours worked for calculation of overtime under
1414 Subsection (e), all hours are counted as hours worked during which
1515 the fire fighter or member of the fire department:
1616 (1) is required to remain available for immediate call
1717 to duty by continuously remaining in contact with the fire
1818 department office by telephone, pager, or radio; or
1919 (2) is taking any authorized leave, including
2020 attendance incentive leave, vacation leave, holiday leave,
2121 compensatory time off, jury duty, military leave, or leave because
2222 of a death in the family.
2323 SECTION 2. This Act takes effect immediately if it receives
2424 a vote of two-thirds of all the members elected to each house, as
2525 provided by Section 39, Article III, Texas Constitution. If this
2626 Act does not receive the vote necessary for immediate effect, this
2727 Act takes effect September 1, 2009.
