| 5 | 5 | | relating to the hours worked during a week by firefighters in |

| 6 | 6 | | certain municipalities. |

| 7 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 8 | 8 | | SECTION 1. Section 142.0015, Local Government Code, is |
|---|
| 9 | 9 | | amended by adding Subsection (e-1) to read as follows: |
|---|
| 10 | 10 | | (e-1) Notwithstanding Subsection (d), in a municipality |
|---|
| 11 | 11 | | with a population of one million or more that has not adopted |
|---|
| 12 | 12 | | Chapter 143, for purposes of determining hours worked, including |
|---|
| 13 | 13 | | determining hours worked for calculation of overtime under |
|---|
| 14 | 14 | | Subsection (e), all hours are counted as hours worked during which |
|---|
| 15 | 15 | | the fire fighter or member of the fire department: |
|---|
| 16 | 16 | | (1) is required to remain available for immediate call |
|---|
| 17 | 17 | | to duty by continuously remaining in contact with the fire |
|---|
| 18 | 18 | | department office by telephone, pager, or radio; or |
|---|
| 19 | 19 | | (2) is taking any authorized leave, including |
|---|
| 20 | 20 | | attendance incentive leave, vacation leave, holiday leave, |
|---|
| 21 | 21 | | compensatory time off, jury duty, military leave, or leave because |
|---|
| 22 | 22 | | of a death in the family. |
|---|
| 23 | 23 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 24 | 24 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 25 | 25 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 26 | 26 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 27 | 27 | | Act takes effect September 1, 2009. |
