77 relating to notice of contract expiration in retail electric
88 service contracts.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter C, Chapter 39, Utilities Code, is
1111 amended by adding Section 39.112 to read as follows:
1212 Sec. 39.112. NOTICE OF CONTRACT EXPIRATION. (a) In this
1313 section, "fixed price contract" means a residential retail electric
1414 service contract for a term of six months or more in which the price
1515 for each billing period is stated in the contract and does not
1616 change throughout the term of the contract. The term does not
1717 include month-to-month service.
1818 (b) A retail electric provider shall provide a residential
1919 customer who has a fixed price contract with written notification
2020 of the date the contract is scheduled to expire. The notice must be
2121 sent to the customer's billing address by mail postmarked not less
2222 than 60 days before the date the contract is scheduled to expire.
2323 SECTION 2. The change in law made by this Act applies only
2424 to a contract for retail electric service entered into or renewed on
2525 or after the effective date of this Act. A contract for retail
2626 electric service entered into or renewed before the effective date
2727 of this Act is governed by the law as it existed immediately before
2828 the effective date of this Act, and that law is continued in effect
2929 for that purpose.
3030 SECTION 3. This Act takes effect September 1, 2009.
