88 AN ACT
99 relating to certain requirements for doctors providing
1010 professional services under the workers' compensation system.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 408.0043, Labor Code, is amended by
1313 adding Subsection (c) to read as follows:
1414 (c) A doctor who performs peer review, utilization review,
1515 or a required medical examination requested by an insurance carrier
1616 must:
1717 (1) if appropriate to the specific case, hold the same
1818 professional certification as the employee's treating doctor;
1919 (2) maintain the doctor's primary practice location in
2020 this state; and
2121 (3) have maintained routine office hours of at least
2222 20 hours per week for the treatment of patients for at least three
2323 years during the doctor's career.
2424 SECTION 2. Section 408.0044, Labor Code, is amended by
2525 adding Subsection (c) to read as follows:
2626 (c) A dentist who performs peer review, utilization review,
2727 or a required dental examination requested by an insurance carrier
2828 must:
2929 (1) maintain the dentist's primary practice location
3030 in this state; and
3131 (2) have maintained routine office hours of at least
3232 20 hours per week for the treatment of patients for at least three
3333 years during the dentist's career.
3434 SECTION 3. Section 408.0045, Labor Code, is amended by
3535 adding Subsection (c) to read as follows:
3636 (c) A chiropractor who performs peer review, utilization
3737 review, or a required medical examination requested by an insurance
3838 carrier must:
3939 (1) maintain the chiropractor's primary practice
4040 location in this state; and
4141 (2) have maintained routine office hours of at least
4242 20 hours per week for the treatment of patients for at least three
4343 years during the chiropractor's career.
4444 SECTION 4. The change in law made by this Act applies only
4545 to professional services provided in conjunction with a claim for
4646 workers' compensation benefits based on a compensable injury that
4747 occurs on or after the effective date of this Act. Professional
4848 services provided in conjunction with a claim based on a
4949 compensable injury that occurs before that date is governed by the
5050 law in effect on the date the compensable injury occurred, and the
5151 former law is continued in effect for that purpose.
5252 SECTION 5. This Act takes effect September 1, 2009.
