55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the closure of a school campus by the board of trustees
88 of a school district.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter D, Chapter 11, Education Code, is
1111 amended by adding Section 11.174 to read as follows:
1212 Sec. 11.174. CAMPUS CLOSURE. (a) Before ordering the
1313 closure of a school campus, the board of trustees of a school
1414 district shall hold a public hearing at which residents of the
1515 district may comment on the proposed closure.
1616 (b) Not later than the seventh day before the date of the
1717 hearing, the board must:
1818 (1) provide written notice of the hearing to the
1919 parent of or person standing in parental relation to each student
2020 affected by the closure; and
2121 (2) publish notice of the hearing in a newspaper of
2222 general circulation in the district.
2323 (c) The notice of the hearing required by Subsection (b)
2424 must include:
2525 (1) the subject matter of the hearing, including the
2626 reason for the proposed closure; and
2727 (2) the location, date, and time of the hearing.
2828 (d) Following a hearing under Subsection (a), the board
2929 shall vote on the proposed closure. If the board votes to close a
3030 school campus, the board shall send the results of the vote to the
3131 commissioner for approval.
3232 (e) The board may not order the closure of a school campus
3333 without first obtaining the approval of the commissioner for the
3434 closure.
3535 (f) The commissioner may adopt rules as necessary to
3636 implement this section.
3737 SECTION 2. This Act takes effect September 1, 2009.
