| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter D, Chapter 11, Education Code, is |
|---|
| 11 | 11 | | amended by adding Section 11.174 to read as follows: |
|---|
| 12 | 12 | | Sec. 11.174. CAMPUS CLOSURE. (a) Before ordering the |
|---|
| 13 | 13 | | closure of a school campus, the board of trustees of a school |
|---|
| 14 | 14 | | district shall hold a public hearing at which residents of the |
|---|
| 15 | 15 | | district may comment on the proposed closure. |
|---|
| 16 | 16 | | (b) Not later than the seventh day before the date of the |
|---|
| 17 | 17 | | hearing, the board must: |
|---|
| 18 | 18 | | (1) provide written notice of the hearing to the |
|---|
| 19 | 19 | | parent of or person standing in parental relation to each student |
|---|
| 20 | 20 | | affected by the closure; and |
|---|
| 21 | 21 | | (2) publish notice of the hearing in a newspaper of |
|---|
| 22 | 22 | | general circulation in the district. |
|---|
| 23 | 23 | | (c) The notice of the hearing required by Subsection (b) |
|---|
| 24 | 24 | | must include: |
|---|
| 25 | 25 | | (1) the subject matter of the hearing, including the |
|---|
| 26 | 26 | | reason for the proposed closure; and |
|---|
| 27 | 27 | | (2) the location, date, and time of the hearing. |
|---|
| 28 | 28 | | (d) Following a hearing under Subsection (a), the board |
|---|
| 29 | 29 | | shall vote on the proposed closure. If the board votes to close a |
|---|
| 30 | 30 | | school campus, the board shall send the results of the vote to the |
|---|
| 31 | 31 | | commissioner for approval. |
|---|
| 32 | 32 | | (e) The board may not order the closure of a school campus |
|---|
| 33 | 33 | | without first obtaining the approval of the commissioner for the |
|---|
| 34 | 34 | | closure. |
|---|
| 35 | 35 | | (f) The commissioner may adopt rules as necessary to |
|---|
| 36 | 36 | | implement this section. |
|---|
| 37 | 37 | | SECTION 2. This Act takes effect September 1, 2009. |
