5	5	relating to the grounds for removal of a member of the board of
6	6	directors of the Lynn County Hospital District.
7	7	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
8	8	SECTION 1. Section 4A(a), Chapter 66, Acts of the 60th
9	9	Legislature, Regular Session, 1967, is amended to read as follows:
10	10	(a) It is a ground for removal from the board of directors
11	11	that a member:
12	12	(1) is absent from more than half [three-fourths] of
13	13	the regularly scheduled board meetings that the member is eligible
14	14	to attend during a calendar year without an excuse approved by a
15	15	majority vote of the board; or
16	16	(2) fails to timely pay a federal, state, or local tax,
17	17	including an ad valorem tax.
18	18	SECTION 2. Section 1054.0565(a), Special District Local
19	19	Laws Code, as effective September 1, 2009, is amended to read as
20	20	follows:
21	21	(a) It is a ground for removal from the board that a
22	22	director:
23	23	(1) is absent from more than half [three-fourths] of
24	24	the regularly scheduled board meetings that the director is
25	25	eligible to attend during a calendar year without an excuse
26	26	approved by a majority vote of the board; or
27	27	(2) fails to timely pay a federal, state, or local tax,
28	28	including an ad valorem tax.
29	29	SECTION 3. (a) Section 1 of this Act takes effect only if
30	30	the Act of the 81st Legislature, Regular Session, 2009, relating to
31	31	nonsubstantive additions to and corrections in existing codes does
32	32	not become law. If the Act of the 81st Legislature, Regular
33	33	Session, 2009, relating to nonsubstantive additions to and
34	34	corrections in existing codes becomes law, Section 1 of this Act has
35	35	no effect.
36	36	(b) Section 2 of this Act takes effect only if the Act of the
37	37	81st Legislature, Regular Session, 2009, relating to
38	38	nonsubstantive additions to and corrections in existing codes
39	39	becomes law. If the Act of the 81st Legislature, Regular Session,
40	40	2009, relating to nonsubstantive additions to and corrections in
41	41	existing codes does not become law, Section 2 of this Act has no
42	42	effect.
43	43	SECTION 4. This Act takes effect September 1, 2009.
