9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. Subchapter D, Chapter 247, Health and Safety | |
11 | 11 | Code, is amended by adding Section 247.071 to read as follows: | |
12 | 12 | Sec. 247.071. DISCHARGE OR TRANSFER OF RESIDENTS ENROLLED | |
13 | 13 | IN MEDICAID COMMUNITY-BASED ALTERNATIVES PROGRAM. An assisted | |
14 | 14 | living facility that accepts a resident who is enrolled in the | |
15 | 15 | Medicaid community-based alternatives program and that voluntarily | |
16 | 16 | ceases to accept payment from the program may not transfer or | |
17 | 17 | discharge the resident from the facility on the basis of the | |
18 | 18 | facility's voluntary withdrawal from the program if the resident is | |
19 | 19 | residing in the facility on the day before the date the facility | |
20 | 20 | ceases to accept payment from the program. | |
21 | 21 | SECTION 2. The change in law made by this Act applies only | |
22 | 22 | to an assisted living facility accepting payment from the Medicaid | |
23 | 23 | community-based alternatives program on or after the effective date | |
24 | 24 | of this Act. | |
25 | 25 | SECTION 3. This Act takes effect September 1, 2009. |
