55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the regulation of metal recycling entities; providing
88 penalties.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 1956.001(10), Occupations Code, is
1111 amended to read as follows:
1212 (10) "Regulated metal" means:
1313 (A) manhole covers;
1414 (B) guardrails;
1515 (C) metal cylinders designed to contain
1616 compressed air, oxygen, gases, or liquids;
1717 (D) beer kegs made from metal other than
1818 aluminum;
1919 (E) historical markers or cemetery vases,
2020 receptacles, or memorials made from metal other than aluminum;
2121 (F) unused rebar;
2222 (G) street signs;
2323 (H) drain gates;
2424 (I) safes;
2525 (J) communication, transmission, and service
2626 wire or cable;
2727 (K) condensing or evaporator coils for heating or
2828 air conditioning units;
2929 (L) utility structures, including the fixtures
3030 and hardware;
3131 (M) aluminum or stainless steel containers
3232 designed to hold propane for fueling forklifts; [and]
3333 (N) metal railroad equipment, including tie
3434 plates, signal houses, control boxes, signs, signals, traffic
3535 devices, traffic control devices, traffic control signals, switch
3636 plates, e-clips, and rail tie functions;
3737 (O) catalytic converters;
3838 (P) metal bleachers or other seating facilities
3939 used in recreational areas or sporting arenas;
4040 (Q) plumbing or electrical fixtures;
4141 (R) tools;
4242 (S) machinery or supplies commonly used in the
4343 drilling, completing, operating, or repairing of oil or gas wells;
4444 (T) stainless steel fittings and fixtures
4545 commonly used in the operation of car wash facilities; and
4646 (U) any metal item marked with any form of the
4747 name, initials, or logo of a government entity, utility, cemetery,
4848 or railroad.
4949 SECTION 2. Section 1956.032(e), Occupations Code, is
5050 amended to read as follows:
5151 (e) The metal recycling entity or the entity's agent for
5252 recordkeeping purposes may take a photograph of the motor vehicle
5353 of the seller in which the make, model, and license plate number of
5454 the motor vehicle are identifiable in lieu of the information
5555 required under Subsection (a)(2) [(a)(3)].
5656 SECTION 3. Section 1956.037(a), Occupations Code, is
5757 amended to read as follows:
5858 (a) A metal recycling entity may not dispose of, process,
5959 sell, or remove from the premises an item of regulated material
6060 [metal] unless:
6161 (1) the entity acquired the item more than 72 hours,
6262 excluding weekends and holidays, before the disposal, processing,
6363 sale, or removal; [or]
6464 (2) for purchases of 35 pounds or more of regulated
6565 material, the entity holds the material separate and apart from all
6666 other purchases so that the regulated material may be readily
6767 identifiable for a period of not less than 10 days, excluding
6868 weekends and holidays, before the disposal, processing, sale, or
6969 removal; or
7070 (3) the entity purchased the item from a
7171 manufacturing, industrial, commercial, retail, or other seller
7272 that sells regulated material in the ordinary course of its
7373 business.
7474 SECTION 4. Subchapter A-3, Chapter 1956, Occupations Code,
7575 is amended by adding Sections 1956.0395 and 1956.0396 to read as
7676 follows:
7777 Sec. 1956.0395. PURCHASE FROM MINOR. (a) A metal recycling
7878 entity may not purchase regulated material from a person younger
7979 than 18 years of age unless a written statement from the seller's
8080 parent or legal guardian consenting to the transaction is provided
8181 to the entity before the transaction.
8282 (b) The metal recycling entity shall retain the statement
8383 with the records required to be kept under this subchapter.
8484 Sec. 1956.0396. INSULATED WIRE. A metal recycling entity
8585 may not purchase or otherwise receive wire that has been burned in
8686 whole or in part to remove the insulation.
8787 SECTION 5. Section 1956.151, Occupations Code, is amended
8888 to read as follows:
8989 Sec. 1956.151. DENIAL OF CERTIFICATE; DISCIPLINARY ACTION.
9090 The department shall deny an application for a certificate of
9191 registration, suspend or revoke a certificate of registration, or
9292 reprimand a person who is registered under this chapter if the
9393 person:
9494 (1) obtains a certificate of registration by means of
9595 fraud, misrepresentation, or concealment of a material fact;
9696 (2) sells, barters, or offers to sell or barter a
9797 certificate of registration;
9898 (3) violates this chapter or a rule adopted under this
9999 chapter; or
100100 (4) violates Section 1956.021.
101101 SECTION 6. This Act takes effect September 1, 2009.
