66 AN ACT
77 relating to the creation of an offense for certain uses of a
88 wireless communication device while operating certain vehicles.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 545.425, Transportation Code, is amended
1111 to read as follows:
1212 Sec. 545.425. USE OF WIRELESS COMMUNICATION DEVICE [BY
1313 CERTAIN MOTORISTS]. (a) An operator [A person] may not use a
1414 wireless communication device while operating a passenger bus with
1515 a minor passenger on the bus except in case of emergency or if the
1616 passenger bus is stopped [not in motion].
1717 (b) Unless the vehicle is stopped, an operator may not use a
1818 wireless communication device to read, write, or send a text-based
1919 communication while operating on a highway:
2020 (1) a motor vehicle, including a moped;
2121 (2) a bicycle or electric bicycle; or
2222 (3) an electric personal assistive mobility device, as
2323 defined by Section 551.201.
2424 SECTION 2. The change in law made by this Act applies only
2525 to an offense committed on or after the effective date of this Act.
2626 An offense committed before the effective date of this Act is
2727 governed by the law in effect when the offense was committed, and
2828 the former law is continued in effect for that purpose. For
2929 purposes of this section, an offense was committed before the
3030 effective date of this Act if any element of the offense was
3131 committed before that date.
3232 SECTION 3. This Act takes effect September 1, 2009.
