55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the authority of general-law municipalities to restrict
88 where sex offenders may live in the municipality.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Chapter 214, Local Government Code, is amended
1111 by adding Section 214.907 to read as follows:
1212 Sec. 214.907. LIMITATIONS ON RESIDENCE OF REGISTERED SEX
1313 OFFENDERS. (a) To provide for the public safety, the governing
1414 body of a general-law municipality by ordinance may restrict in the
1515 municipality the proximity of the residence of an individual who is
1616 required to register as a sex offender under Chapter 62, Code of
1717 Criminal Procedure, to the location of a premises where children
1818 commonly gather.
1919 (b) For purposes of this section:
2020 (1) "Premises where children commonly gather"
2121 includes a school, day-care facility, playground, public or private
2222 youth center, public swimming pool, or video arcade facility.
2323 (2) "Playground," "premises," "school," "video arcade
2424 facility," and "youth center" have the meanings assigned by Section
2525 481.134, Health and Safety Code.
2626 SECTION 2. This Act takes effect immediately if it receives
2727 a vote of two-thirds of all the members elected to each house, as
2828 provided by Section 39, Article III, Texas Constitution. If this
2929 Act does not receive the vote necessary for immediate effect, this
3030 Act takes effect September 1, 2009.
