| 5 | 5 | | relating to limitations on the compensation of county auditors for |

| 7 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|---|
| 8 | 8 | | SECTION 1. Section 152.032(d), Local Government Code, as |
|---|
| 9 | 9 | | amended by Chapters 401 (S.B. 833), 430 (S.B. 1630), and 1260 (H.B. |
|---|
| 10 | 10 | | 2917), Acts of the 80th Legislature, Regular Session, 2007, is |
|---|
| 11 | 11 | | reenacted and amended to read as follows: |
|---|
| 12 | 12 | | (d) The amount of the compensation and allowances of a |
|---|
| 13 | 13 | | county auditor in a county subject to this subsection may be set in |
|---|
| 14 | 14 | | an amount that exceeds the limit established by [in] Subsection (a) |
|---|
| 15 | 15 | | if the compensation and allowances are approved by the |
|---|
| 16 | 16 | | commissioners court of the county. This subsection applies only |
|---|
| 17 | 17 | | to: |
|---|
| 18 | 18 | | (1) a county with a population of more than 77,000 and |
|---|
| 19 | 19 | | less than 80,000; |
|---|
| 20 | 20 | | (2) a county with a population of 120,000 [500,000] or |
|---|
| 21 | 21 | | more, excluding a county subject to Subsection (b); |
|---|
| 22 | 22 | | (3) a county with a population of more than 1,000 and |
|---|
| 23 | 23 | | less than 21,000 that borders the Gulf of Mexico; and |
|---|
| 24 | 24 | | (4) a county that borders a county subject to |
|---|
| 25 | 25 | | Subsection (b) and that has a population of more [greater] than |
|---|
| 26 | 26 | | 50,000 and less than 85,000. |
|---|
| 27 | 27 | | SECTION 2. To the extent of any conflict, this Act prevails |
|---|
| 28 | 28 | | over another Act of the 81st Legislature, Regular Session, 2009, |
|---|
| 29 | 29 | | relating to nonsubstantive additions to and corrections in enacted |
|---|
| 30 | 30 | | codes. |
|---|
| 31 | 31 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 32 | 32 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 33 | 33 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 34 | 34 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 35 | 35 | | Act takes effect September 1, 2009. |
