77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Sections 161.501 and 161.502, Health and Safety
99 Code, are amended to read as follows:
1010 Sec. 161.501. RESOURCE PAMPHLET AND RESOURCE GUIDE PROVIDED
1111 TO PARENTS OF NEWBORN CHILDREN. (a) A hospital, birthing center,
1212 physician, nurse midwife, or midwife who provides prenatal care to
1313 a pregnant woman during gestation or at delivery of an infant shall:
1414 (1) provide the woman and the father of the infant, if
1515 possible, or another adult caregiver for the infant, with a
1616 resource pamphlet that includes:
1717 (A) a list of the names, addresses, and phone
1818 numbers of professional organizations that provide postpartum
1919 counseling and assistance to parents relating to postpartum
2020 depression and other emotional trauma associated with pregnancy and
2121 parenting;
2222 (B) information regarding the prevention of
2323 shaken baby syndrome including:
2424 (i) techniques for coping with anger caused
2525 by a crying baby;
2626 (ii) different methods for preventing a
2727 person from shaking a newborn, infant, or other young child;
2828 (iii) the dangerous effects of shaking a
2929 newborn, infant, or other young child; and
3030 (iv) the symptoms of shaken baby syndrome
3131 and who to contact, as recommended by the American Academy of
3232 Pediatrics, if a parent suspects or knows that a baby has been
3333 shaken in order to receive prompt medical treatment;
3434 (C) a list of diseases for which a child is
3535 required by state law to be immunized and the appropriate schedule
3636 for the administration of those immunizations; and
3737 (D) the appropriate schedule for follow-up
3838 procedures for newborn screening;
3939 (2) if the woman is a recipient of medical assistance
4040 under Chapter 32, Human Resources Code, provide the woman and the
4141 father of the infant, if possible, or another adult caregiver with a
4242 resource guide that includes information in both English and
4343 Spanish relating to the development, health, and safety of a child
4444 from birth until age five, including information relating to:
4545 (A) selecting and interacting with a primary
4646 health care practitioner and establishing a "medical home" for the
4747 child;
4848 (B) dental care;
4949 (C) effective parenting;
5050 (D) child safety;
5151 (E) the importance of reading to a child;
5252 (F) expected developmental milestones;
5353 (G) health care resources available in the state;
5454 (H) selecting appropriate child care; and
5555 (I) other resources available in the state;
5656 (3) document in the woman's record that the woman
5757 received the resource pamphlet [information] described in
5858 Subdivision (1) and the resource guide described in Subdivision
5959 (2), if applicable; and
6060 (4) [(3)] retain the documentation for at least five
6161 years in the hospital's, birthing center's, physician's, nurse
6262 midwife's, or midwife's records.
6363 (b) A hospital, birthing center, physician, nurse midwife,
6464 or midwife:
6565 (1) may use the pamphlet provided on the department's
6666 website or an alternative pamphlet that provides the information
6767 required by Subsection (a)(1); and
6868 (2) may use the resource guide provided on the
6969 department's website or an alternative guide that provides the
7070 information required by Subsection (a)(2) [this section].
7171 (c) The department may make available online and distribute
7272 an existing publication created by another health and human
7373 services agency as the resource guide required by Subsection
7474 (a)(2).
7575 Sec. 161.502. DUTIES OF DEPARTMENT. (a) The department
7676 shall:
7777 (1) establish guidelines for the provision of the
7878 information required by Section 161.501;
7979 (2) make available on the department's website:
8080 (A) a printable version of the pamphlet required
8181 by Section 161.501(a)(1) [161.501]; and
8282 (B) a printable version of the resource guide
8383 required by Section 161.501(a)(2);
8484 (3) update the list of resources and required
8585 immunizations in the pamphlet required under Subdivision (2)(A)
8686 [(2)] quarterly;
8787 (4) make the pamphlet and resource guide required by
8888 Section 161.501 available for distribution to hospitals,
8989 physicians, birthing centers, nurse midwives, and midwives; and
9090 (5) coordinate funding for the development,
9191 publication, and distribution of the informational pamphlet and
9292 resource guide with other health and human services agencies, and
9393 solicit funding for the department's duties under this subchapter
9494 through means other than appropriations, such as gifts, grants, and
9595 sales of sponsorship or advertising.
9696 (b) The department may include additional information in
9797 the pamphlet or resource guide as appropriate for parents of
9898 newborns.
9999 (c) The Health and Human Services Commission shall develop
100100 specific performance measures by which the commission may evaluate
101101 the effectiveness of the resource guide under Section 161.501(a)(2)
102102 in:
103103 (1) reducing costs to the state; and
104104 (2) improving outcomes for children.
105105 (d) Not later than December 1 of each even-numbered year,
106106 the Health and Human Services Commission shall submit a report to
107107 the legislature on the effectiveness of the resource guide under
108108 Section 161.501(a)(2), including legislative recommendations
109109 concerning the guide.
110110 SECTION 2. This Act takes effect September 1, 2009.
