7 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
---|
8 | 8 | | SECTION 1. Sections 161.501 and 161.502, Health and Safety |
---|
9 | 9 | | Code, are amended to read as follows: |
---|
10 | 10 | | Sec. 161.501. RESOURCE PAMPHLET AND RESOURCE GUIDE PROVIDED |
---|
11 | 11 | | TO PARENTS OF NEWBORN CHILDREN. (a) A hospital, birthing center, |
---|
12 | 12 | | physician, nurse midwife, or midwife who provides prenatal care to |
---|
13 | 13 | | a pregnant woman during gestation or at delivery of an infant shall: |
---|
14 | 14 | | (1) provide the woman and the father of the infant, if |
---|
15 | 15 | | possible, or another adult caregiver for the infant, with a |
---|
16 | 16 | | resource pamphlet that includes: |
---|
17 | 17 | | (A) a list of the names, addresses, and phone |
---|
18 | 18 | | numbers of professional organizations that provide postpartum |
---|
19 | 19 | | counseling and assistance to parents relating to postpartum |
---|
20 | 20 | | depression and other emotional trauma associated with pregnancy and |
---|
21 | 21 | | parenting; |
---|
22 | 22 | | (B) information regarding the prevention of |
---|
23 | 23 | | shaken baby syndrome including: |
---|
24 | 24 | | (i) techniques for coping with anger caused |
---|
25 | 25 | | by a crying baby; |
---|
26 | 26 | | (ii) different methods for preventing a |
---|
27 | 27 | | person from shaking a newborn, infant, or other young child; |
---|
28 | 28 | | (iii) the dangerous effects of shaking a |
---|
29 | 29 | | newborn, infant, or other young child; and |
---|
30 | 30 | | (iv) the symptoms of shaken baby syndrome |
---|
31 | 31 | | and who to contact, as recommended by the American Academy of |
---|
32 | 32 | | Pediatrics, if a parent suspects or knows that a baby has been |
---|
33 | 33 | | shaken in order to receive prompt medical treatment; |
---|
34 | 34 | | (C) a list of diseases for which a child is |
---|
35 | 35 | | required by state law to be immunized and the appropriate schedule |
---|
36 | 36 | | for the administration of those immunizations; and |
---|
37 | 37 | | (D) the appropriate schedule for follow-up |
---|
38 | 38 | | procedures for newborn screening; |
---|
39 | 39 | | (2) if the woman is a recipient of medical assistance |
---|
40 | 40 | | under Chapter 32, Human Resources Code, provide the woman and the |
---|
41 | 41 | | father of the infant, if possible, or another adult caregiver with a |
---|
42 | 42 | | resource guide that includes information in both English and |
---|
43 | 43 | | Spanish relating to the development, health, and safety of a child |
---|
44 | 44 | | from birth until age five, including information relating to: |
---|
45 | 45 | | (A) selecting and interacting with a primary |
---|
46 | 46 | | health care practitioner and establishing a "medical home" for the |
---|
47 | 47 | | child; |
---|
48 | 48 | | (B) dental care; |
---|
49 | 49 | | (C) effective parenting; |
---|
50 | 50 | | (D) child safety; |
---|
51 | 51 | | (E) the importance of reading to a child; |
---|
52 | 52 | | (F) expected developmental milestones; |
---|
53 | 53 | | (G) health care resources available in the state; |
---|
54 | 54 | | (H) selecting appropriate child care; and |
---|
55 | 55 | | (I) other resources available in the state; |
---|
56 | 56 | | (3) document in the woman's record that the woman |
---|
57 | 57 | | received the resource pamphlet [information] described in |
---|
58 | 58 | | Subdivision (1) and the resource guide described in Subdivision |
---|
59 | 59 | | (2), if applicable; and |
---|
60 | 60 | | (4) [(3)] retain the documentation for at least five |
---|
61 | 61 | | years in the hospital's, birthing center's, physician's, nurse |
---|
62 | 62 | | midwife's, or midwife's records. |
---|
63 | 63 | | (b) A hospital, birthing center, physician, nurse midwife, |
---|
64 | 64 | | or midwife: |
---|
65 | 65 | | (1) may use the pamphlet provided on the department's |
---|
66 | 66 | | website or an alternative pamphlet that provides the information |
---|
67 | 67 | | required by Subsection (a)(1); and |
---|
68 | 68 | | (2) may use the resource guide provided on the |
---|
69 | 69 | | department's website or an alternative guide that provides the |
---|
70 | 70 | | information required by Subsection (a)(2) [this section]. |
---|
71 | 71 | | (c) The department may make available online and distribute |
---|
72 | 72 | | an existing publication created by another health and human |
---|
73 | 73 | | services agency as the resource guide required by Subsection |
---|
74 | 74 | | (a)(2). |
---|
75 | 75 | | Sec. 161.502. DUTIES OF DEPARTMENT. (a) The department |
---|
76 | 76 | | shall: |
---|
77 | 77 | | (1) establish guidelines for the provision of the |
---|
78 | 78 | | information required by Section 161.501; |
---|
79 | 79 | | (2) make available on the department's website: |
---|
80 | 80 | | (A) a printable version of the pamphlet required |
---|
81 | 81 | | by Section 161.501(a)(1) [161.501]; and |
---|
82 | 82 | | (B) a printable version of the resource guide |
---|
83 | 83 | | required by Section 161.501(a)(2); |
---|
84 | 84 | | (3) update the list of resources and required |
---|
85 | 85 | | immunizations in the pamphlet required under Subdivision (2)(A) |
---|
86 | 86 | | [(2)] quarterly; |
---|
87 | 87 | | (4) make the pamphlet and resource guide required by |
---|
88 | 88 | | Section 161.501 available for distribution to hospitals, |
---|
89 | 89 | | physicians, birthing centers, nurse midwives, and midwives; and |
---|
90 | 90 | | (5) coordinate funding for the development, |
---|
91 | 91 | | publication, and distribution of the informational pamphlet and |
---|
92 | 92 | | resource guide with other health and human services agencies, and |
---|
93 | 93 | | solicit funding for the department's duties under this subchapter |
---|
94 | 94 | | through means other than appropriations, such as gifts, grants, and |
---|
95 | 95 | | sales of sponsorship or advertising. |
---|
96 | 96 | | (b) The department may include additional information in |
---|
97 | 97 | | the pamphlet or resource guide as appropriate for parents of |
---|
98 | 98 | | newborns. |
---|
99 | 99 | | (c) The Health and Human Services Commission shall develop |
---|
100 | 100 | | specific performance measures by which the commission may evaluate |
---|
101 | 101 | | the effectiveness of the resource guide under Section 161.501(a)(2) |
---|
102 | 102 | | in: |
---|
103 | 103 | | (1) reducing costs to the state; and |
---|
104 | 104 | | (2) improving outcomes for children. |
---|
105 | 105 | | (d) Not later than December 1 of each even-numbered year, |
---|
106 | 106 | | the Health and Human Services Commission shall submit a report to |
---|
107 | 107 | | the legislature on the effectiveness of the resource guide under |
---|
108 | 108 | | Section 161.501(a)(2), including legislative recommendations |
---|
109 | 109 | | concerning the guide. |
---|
110 | 110 | | SECTION 2. This Act takes effect September 1, 2009. |
