66 AN ACT
77 relating to student/teacher ratios and class size limits for
88 prekindergarten classes in public schools.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 25.111, Education Code, is amended to
1111 read as follows:
1212 Sec. 25.111. STUDENT/TEACHER RATIOS. Except as provided by
1313 Section 25.112, each school district must:
1414 (1) employ a sufficient number of teachers certified
1515 under Subchapter B, Chapter 21, to maintain an average ratio of not
1616 less than one teacher for each 20 students in average daily
1717 attendance above the prekindergarten level; and
1818 (2) employ a sufficient number of teachers certified
1919 under Subchapter B, Chapter 21, and teacher's aides to maintain an
2020 average ratio of not less than one teacher or teacher's aide for
2121 each nine students in average daily attendance at the
2222 prekindergarten level.
2323 SECTION 2. Section 25.112(a), Education Code, is amended to
2424 read as follows:
2525 (a) Except as otherwise authorized by this section, a school
2626 district may not enroll more than 18 students in a prekindergarten
2727 class or 22 students in a kindergarten, first, second, third, or
2828 fourth grade class. That limitation does not apply during:
2929 (1) any 12-week period of the school year selected by
3030 the district, in the case of a district whose average daily
3131 attendance is adjusted under Section 42.005(c); or
3232 (2) the last 12 weeks of any school year in the case of
3333 any other district.
3434 SECTION 3. This Act applies beginning with the 2009-2010
3535 school year.
3636 SECTION 4. This Act takes effect immediately if it receives
3737 a vote of two-thirds of all the members elected to each house, as
3838 provided by Section 39, Article III, Texas Constitution. If this
3939 Act does not receive the vote necessary for immediate effect, this
4040 Act takes effect September 1, 2009.
