| 7 | 7 | | relating to student/teacher ratios and class size limits for |

| 8 | 8 | | prekindergarten classes in public schools. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 25.111, Education Code, is amended to |
|---|
| 11 | 11 | | read as follows: |
|---|
| 12 | 12 | | Sec. 25.111. STUDENT/TEACHER RATIOS. Except as provided by |
|---|
| 13 | 13 | | Section 25.112, each school district must: |
|---|
| 14 | 14 | | (1) employ a sufficient number of teachers certified |
|---|
| 15 | 15 | | under Subchapter B, Chapter 21, to maintain an average ratio of not |
|---|
| 16 | 16 | | less than one teacher for each 20 students in average daily |
|---|
| 17 | 17 | | attendance above the prekindergarten level; and |
|---|
| 18 | 18 | | (2) employ a sufficient number of teachers certified |
|---|
| 19 | 19 | | under Subchapter B, Chapter 21, and teacher's aides to maintain an |
|---|
| 20 | 20 | | average ratio of not less than one teacher or teacher's aide for |
|---|
| 21 | 21 | | each nine students in average daily attendance at the |
|---|
| 22 | 22 | | prekindergarten level. |
|---|
| 23 | 23 | | SECTION 2. Section 25.112(a), Education Code, is amended to |
|---|
| 24 | 24 | | read as follows: |
|---|
| 25 | 25 | | (a) Except as otherwise authorized by this section, a school |
|---|
| 26 | 26 | | district may not enroll more than 18 students in a prekindergarten |
|---|
| 27 | 27 | | class or 22 students in a kindergarten, first, second, third, or |
|---|
| 28 | 28 | | fourth grade class. That limitation does not apply during: |
|---|
| 29 | 29 | | (1) any 12-week period of the school year selected by |
|---|
| 30 | 30 | | the district, in the case of a district whose average daily |
|---|
| 31 | 31 | | attendance is adjusted under Section 42.005(c); or |
|---|
| 32 | 32 | | (2) the last 12 weeks of any school year in the case of |
|---|
| 33 | 33 | | any other district. |
|---|
| 34 | 34 | | SECTION 3. This Act applies beginning with the 2009-2010 |
|---|
| 35 | 35 | | school year. |
|---|
| 36 | 36 | | SECTION 4. This Act takes effect immediately if it receives |
|---|
| 37 | 37 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 38 | 38 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 39 | 39 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 40 | 40 | | Act takes effect September 1, 2009. |
