66 AN ACT
77 relating to fees, adjustments, corrections, and repairs in
88 connection with a vehicle inspection.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 548.053, Transportation Code, is amended
1111 by adding Subsection (d) to read as follows:
1212 (d) If an inspection discloses the necessity for
1313 adjustment, correction, or repair and if the inspection station is
1414 in the business of making those adjustments, corrections, or
1515 repairs, the owner or operator of the vehicle is entitled to an
1616 estimate of the cost, including the cost of all parts and labor,
1717 that the inspection station would charge to make the needed
1818 adjustment, correction, or repair. The inspection station may not
1919 charge the owner or operator for an adjustment, correction, or
2020 repair that is not specifically authorized in advance by the owner
2121 or operator.
2222 SECTION 2. Section 548.501, Transportation Code, is amended
2323 by adding Subsection (c) to read as follows:
2424 (c) An inspection station may collect the applicable
2525 inspection fee at the time of the original inspection of a vehicle,
2626 regardless of whether an inspection certificate is issued at that
2727 time. An inspection fee may be included with charges for other
2828 products or services but must be shown on a work order for the
2929 products or services as a separate item. An inspection fee may be
3030 advertised in conjunction with other products or services.
3131 SECTION 3. This Act takes effect September 1, 2009.
