77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Subchapter C, Chapter 791, Government Code, is
99 amended by adding Section 791.034 to read as follows:
1010 Sec. 791.034. INTERLOCAL CONTRACT FOR RELIEF HIGHWAY ROUTE
1111 AROUND CERTAIN MUNICIPALITIES. (a) The governing body of a
1212 municipality located in a county in which is located a facility
1313 licensed to dispose of low-level radioactive waste under Chapter
1414 401, Health and Safety Code, may enter into an interlocal contract
1515 with the county for the construction and maintenance of a relief
1616 highway route around and outside the boundaries of the municipality
1717 that the governing body determines will serve a public purpose of
1818 the municipality.
1919 (b) The municipality may expend municipal funds and may
2020 issue certificates of obligation or bonds to pay for expenses
2121 associated with a relief highway route under Subsection (a).
2222 SECTION 2. This Act takes effect immediately if it receives
2323 a vote of two-thirds of all the members elected to each house, as
2424 provided by Section 39, Article III, Texas Constitution. If this
2525 Act does not receive the vote necessary for immediate effect, this
2626 Act takes effect September 1, 2009.
