| 7 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 8 | 8 | | SECTION 1. Subchapter C, Chapter 791, Government Code, is |
|---|
| 9 | 9 | | amended by adding Section 791.034 to read as follows: |
|---|
| 10 | 10 | | Sec. 791.034. INTERLOCAL CONTRACT FOR RELIEF HIGHWAY ROUTE |
|---|
| 11 | 11 | | AROUND CERTAIN MUNICIPALITIES. (a) The governing body of a |
|---|
| 12 | 12 | | municipality located in a county in which is located a facility |
|---|
| 13 | 13 | | licensed to dispose of low-level radioactive waste under Chapter |
|---|
| 14 | 14 | | 401, Health and Safety Code, may enter into an interlocal contract |
|---|
| 15 | 15 | | with the county for the construction and maintenance of a relief |
|---|
| 16 | 16 | | highway route around and outside the boundaries of the municipality |
|---|
| 17 | 17 | | that the governing body determines will serve a public purpose of |
|---|
| 18 | 18 | | the municipality. |
|---|
| 19 | 19 | | (b) The municipality may expend municipal funds and may |
|---|
| 20 | 20 | | issue certificates of obligation or bonds to pay for expenses |
|---|
| 21 | 21 | | associated with a relief highway route under Subsection (a). |
|---|
| 22 | 22 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 23 | 23 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 24 | 24 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 25 | 25 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 26 | 26 | | Act takes effect September 1, 2009. |
