8 | 8 | | to the Teacher Retirement System of Texas. |

9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 10 | | SECTION 1. Section 825.203, Government Code, is amended to |
---|
11 | 11 | | read as follows: |
---|
12 | 12 | | Sec. 825.203. LEGAL REPRESENTATION [ADVISER]. (a) The |
---|
13 | 13 | | attorney general of the state is the legal adviser of the board of |
---|
14 | 14 | | trustees. The attorney general shall represent the board in all |
---|
15 | 15 | | litigation. |
---|
16 | 16 | | (b) The board may not employ outside legal counsel to |
---|
17 | 17 | | provide legal services to the retirement system except as provided |
---|
18 | 18 | | by Section 402.0212, regardless of the source of funds to be used to |
---|
19 | 19 | | pay the outside counsel. For purposes of this subsection, "legal |
---|
20 | 20 | | services" includes services provided by an attorney regarding |
---|
21 | 21 | | ethics and fiduciary responsibilities. |
---|
22 | 22 | | SECTION 2. Section 825.203(b), Government Code, as added by |
---|
23 | 23 | | this Act, is intended to clarify rather than change existing law. |
---|
24 | 24 | | SECTION 3. This Act takes effect immediately if it receives |
---|
25 | 25 | | a vote of two-thirds of all the members elected to each house, as |
---|
26 | 26 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
27 | 27 | | Act does not receive the vote necessary for immediate effect, this |
---|
28 | 28 | | Act takes effect September 1, 2009. |
