6	6	AN ACT
7	7	relating to the addition of Salvia divinorum and its derivatives
8	8	and extracts to Penalty Group 3 of the Texas Controlled Substances
9	9	Act.
10	10	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
11	11	SECTION 1. Section 481.104(a), Health and Safety Code, is
12	12	amended to read as follows:
13	13	(a) Penalty Group 3 consists of:
14	14	(1) a material, compound, mixture, or preparation that
15	15	contains any quantity of the following substances having a
16	16	potential for abuse associated with a stimulant effect on the
17	17	central nervous system:
18	18	Methylphenidate and its salts; and
19	19	Phenmetrazine and its salts;
20	20	(2) a material, compound, mixture, or preparation that
21	21	contains any quantity of the following substances having a
22	22	potential for abuse associated with a depressant effect on the
23	23	central nervous system:
24	24	a substance that contains any quantity of a
25	25	derivative of barbituric acid, or any salt of a derivative of
26	26	barbituric acid not otherwise described by this subsection;
27	27	a compound, mixture, or preparation containing
28	28	amobarbital, secobarbital, pentobarbital, or any salt of any of
29	29	these, and one or more active medicinal ingredients that are not
30	30	listed in any penalty group;
31	31	a suppository dosage form containing amobarbital,
32	32	secobarbital, pentobarbital, or any salt of any of these drugs, and
33	33	approved by the United States Food and Drug Administration for
34	34	marketing only as a suppository;
35	35	Alprazolam;
36	36	Amobarbital;
37	37	Bromazepam;
38	38	Camazepam;
39	39	Chlordiazepoxide;
40	40	Chlorhexadol;
41	41	Clobazam;
42	42	Clonazepam;
43	43	Clorazepate;

100	100	unit, with an equal or greater quantity of an isoquinoline alkaloid
101	101	of opium;
102	102	not more than 1.8 grams of codeine, or any of its
103	103	salts, per 100 milliliters or not more than 90 milligrams per dosage
104	104	unit, with one or more active, nonnarcotic ingredients in
105	105	recognized therapeutic amounts;
106	106	not more than 300 milligrams of dihydrocodeinone
107	107	(hydrocodone), or any of its salts, per 100 milliliters or not more
108	108	than 15 milligrams per dosage unit, with a fourfold or greater
109	109	quantity of an isoquinoline alkaloid of opium;
110	110	not more than 300 milligrams of dihydrocodeinone
111	111	(hydrocodone), or any of its salts, per 100 milliliters or not more
112	112	than 15 milligrams per dosage unit, with one or more active,
113	113	nonnarcotic ingredients in recognized therapeutic amounts;
114	114	not more than 1.8 grams of dihydrocodeine, or any
115	115	of its salts, per 100 milliliters or not more than 90 milligrams per
116	116	dosage unit, with one or more active, nonnarcotic ingredients in
117	117	recognized therapeutic amounts;
118	118	not more than 300 milligrams of ethylmorphine, or
119	119	any of its salts, per 100 milliliters or not more than 15 milligrams
120	120	per dosage unit, with one or more active, nonnarcotic ingredients
121	121	in recognized therapeutic amounts;
122	122	not more than 500 milligrams of opium per 100
123	123	milliliters or per 100 grams, or not more than 25 milligrams per
124	124	dosage unit, with one or more active, nonnarcotic ingredients in
125	125	recognized therapeutic amounts;
126	126	not more than 50 milligrams of morphine, or any of
127	127	its salts, per 100 milliliters or per 100 grams with one or more
128	128	active, nonnarcotic ingredients in recognized therapeutic amounts;
129	129	and
130	130	not more than 1 milligram of difenoxin and not
131	131	less than 25 micrograms of atropine sulfate per dosage unit;
132	132	(5) a material, compound, mixture, or preparation that
133	133	contains any quantity of the following substances:
134	134	Barbital;
135	135	Chloral betaine;
136	136	Chloral hydrate;
137	137	Ethchlorvynol;
138	138	Ethinamate;
139	139	Meprobamate;
140	140	Methohexital;
141	141	Methylphenobarbital (Mephobarbital);
142	142	Paraldehyde;
143	143	Petrichloral; and
144	144	Phenobarbital;
145	145	(6) Peyote, unless unharvested and growing in its
146	146	natural state, meaning all parts of the plant classified
147	147	botanically as Lophophora, whether growing or not, the seeds of the
148	148	plant, an extract from a part of the plant, and every compound,
149	149	manufacture, salt, derivative, mixture, or preparation of the
150	150	plant, its seeds, or extracts;
151	151	(7) unless listed in another penalty group, a
152	152	material, compound, mixture, or preparation that contains any
153	153	quantity of the following substances having a stimulant effect on
154	154	the central nervous system, including the substance's salts,
155	155	optical, position, or geometric isomers, and salts of the
156	156	substance's isomers, if the existence of the salts, isomers, and
157	157	salts of isomers is possible within the specific chemical
158	158	designation:
159	159	Benzphetamine;
160	160	Cathine [(+)-norpseudoephedrine];
161	161	Chlorphentermine;
162	162	Clortermine;
163	163	Diethylpropion;
164	164	Fencamfamin;
165	165	Fenfluramine;
166	166	Fenproporex;
167	167	Mazindol;
168	168	Mefenorex;
169	169	Modafinil;
170	170	Pemoline (including organometallic complexes and
171	171	their chelates);
172	172	Phendimetrazine;
173	173	Phentermine;

183	183	(9) an anabolic steroid or any substance that is
184	184	chemically or pharmacologically related to testosterone, other
185	185	than an estrogen, progestin, or corticosteroid, and promotes muscle
186	186	growth, including:
187	187	Boldenone;
188	188	Chlorotestosterone (4-chlortestosterone);
189	189	Clostebol;
190	190	Dehydrochlormethyltestosterone;
191	191	Dihydrotestosterone (4-dihydrotestosterone);

194	194	Fluoxymesterone;

197	197	Methandienone;

220	220	SECTION 2. This Act takes effect September 1, 2009.
