| 9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 10 | 10 | SECTION 1. Section 395.022(b), Local Government Code, is | |
| 11 | 11 | amended to read as follows: | |
| 12 | 12 | (b) A school district is not required to pay impact fees | |
| 13 | 13 | imposed under this chapter, including fees for an individual meter | |
| 14 | 14 | connection to a municipality's water or wastewater system, unless | |
| 15 | 15 | the board of trustees of the district consents to the payment of the | |
| 16 | 16 | fees by entering a contract with the political subdivision that | |
| 17 | 17 | imposes the fees. The contract may contain terms the board of | |
| 18 | 18 | trustees considers advisable to provide for the payment of the | |
| 19 | 19 | fees. | |
| 20 | 20 | SECTION 2. This Act takes effect immediately if it receives | |
| 21 | 21 | a vote of two-thirds of all the members elected to each house, as | |
| 22 | 22 | provided by Section 39, Article III, Texas Constitution. If this | |
| 23 | 23 | Act does not receive the vote necessary for immediate effect, this | |
| 24 | 24 | Act takes effect September 1, 2009. |
