77 relating to property owner, contractor, and subcontractor
88 liability for certain damages.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 95.001, Civil Practice and Remedies
1111 Code, is amended by adding Subdivision (4) to read as follows:
1212 (4) "Improvement to real property" means a structure or
1313 part of a structure permanently affixed to or incorporated into
1414 real property. The term does not include scaffolding, ladders, or
1515 other temporary structures used in the construction, repair,
1616 renovation, or modification of the improvement.
1717 SECTION 2. Section 95.003, Civil Practice and Remedies
1818 Code, is amended to read as follows:
1919 Sec. 95.003. LIABILITY FOR ACTS OF INDEPENDENT
2020 CONTRACTORS. A property owner is not liable for personal injury,
2121 death, or property damage to a contractor, subcontractor, or an
2222 employee of a contractor or subcontractor who constructs, repairs,
2323 renovates, or modifies an improvement to real property, including
2424 personal injury, death, or property damage arising from the failure
2525 to provide a safe workplace unless:
2626 (1) the property owner exercises or retains some
2727 control over the manner in which the work is performed, other than
2828 the right to order the work to start or stop or to inspect progress
2929 or receive reports; and
3030 (2) the property owner created or had actual or
3131 constructive knowledge of the danger or condition resulting in the
3232 personal injury, death, or property damage and failed to correct or
3333 adequately warn of the danger or condition.
3434 SECTION 3. The change in law made by this Act applies only
3535 to a cause of action that accrues on or after the effective date of
3636 this Act. A cause of action that accrues before the effective date
3737 of this Act is governed by the law in effect immediately before that
3838 date, and that law is continued in effect for that purpose.
3939 SECTION 4. This Act takes effect September 1, 2009.
