| 10 | 10 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 11 | 11 | SECTION 1. Section 39.1324, Education Code, is amended by | |
| 12 | 12 | adding Subsection (a-1) to read as follows: | |
| 13 | 13 | (a-1) Notwithstanding Subsection (a), a campus may not be | |
| 14 | 14 | reconstituted in accordance with an order of the commissioner under | |
| 15 | 15 | that subsection unless academic tutoring for students is made | |
| 16 | 16 | available at the campus at state expense during the school year | |
| 17 | 17 | preceding the school year in which the campus is anticipated to open | |
| 18 | 18 | as a reconstituted campus. | |
| 19 | 19 | SECTION 2. This Act applies only to a campus subject to an | |
| 20 | 20 | order of the commissioner of education under Section 39.1324(a), | |
| 21 | 21 | Education Code, that is issued on or after the effective date of | |
| 22 | 22 | this Act. | |
| 23 | 23 | SECTION 3. This Act takes effect immediately if it receives | |
| 24 | 24 | a vote of two-thirds of all the members elected to each house, as | |
| 25 | 25 | provided by Section 39, Article III, Texas Constitution. If this | |
| 26 | 26 | Act does not receive the vote necessary for immediate effect, this | |
| 27 | 27 | Act takes effect September 1, 2009. |
