99 AN ACT
1010 relating to bullying and harassment in public schools.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. The heading to Section 25.0342, Education Code,
1313 is amended to read as follows:
1414 Sec. 25.0342. TRANSFER OF STUDENTS WHO ARE VICTIMS OF OR
1515 HAVE ENGAGED IN BULLYING.
1616 SECTION 2. Section 25.0342, Education Code, is amended by
1717 amending Subsections (a), (c), and (e) and adding Subsections (b-1)
1818 and (b-2) to read as follows:
1919 (a) In this section, "bullying" means engaging in physical
2020 conduct or written or verbal expression, including expression
2121 through electronic means, on or off of school property, [or
2222 physical conduct] that a school district board of trustees or the
2323 board's designee determines:
2424 (1) will have the effect of physically harming a
2525 student, damaging a student's property, or placing a student in
2626 reasonable fear of harm to the student's person or of damage to the
2727 student's property; [or]
2828 (2) is sufficiently severe, persistent, or pervasive
2929 enough that the action or threat creates an intimidating,
3030 threatening, or abusive educational environment for a student; or
3131 (3) substantially disrupts the orderly operation of a
3232 school.
3333 (b-1) On the request of a parent or other person with
3434 authority to act on behalf of a student who is a victim of bullying,
3535 the board of trustees of a school district or the board's designee
3636 may transfer the student who engaged in bullying to:
3737 (1) another classroom at the campus to which the
3838 victim was assigned at the time the bullying occurred; or
3939 (2) a campus in the district other than the campus to
4040 which the victim was assigned at the time the bullying occurred.
4141 (b-2) To the extent practicable, the board of trustees and
4242 each district educator with knowledge of the request shall keep a
4343 request received under Subsection (b) or (b-1) confidential.
4444 (c) The board of trustees or the board's designee shall
4545 verify that a student has been a victim of or has engaged in
4646 bullying, as applicable, before transferring the student under this
4747 section.
4848 (e) The determination by the board of trustees or the
4949 board's designee under Subsection (c) is final and may not be
5050 appealed.
5151 SECTION 3. Section 37.001(b), Education Code, is amended to
5252 read as follows:
5353 (b) In this section:
5454 (1) "Bullying" has the meaning assigned by Section
5555 25.0342.
5656 (2) "Harassment" means threatening to cause harm or
5757 bodily injury to another student, engaging in sexually intimidating
5858 conduct, causing physical damage to the property of another
5959 student, subjecting another student to physical confinement or
6060 restraint, or maliciously taking any action that substantially
6161 harms another student's physical or emotional health or safety.
6262 (3) [(2)] "Hit list" means a list of people targeted
6363 to be harmed, using:
6464 (A) a firearm, as defined by Section 46.01(3),
6565 Penal Code;
6666 (B) a knife, as defined by Section 46.01(7),
6767 Penal Code; or
6868 (C) any other object to be used with intent to
6969 cause bodily harm.
7070 SECTION 4. Section 37.083, Education Code, is amended to
7171 read as follows:
7272 Sec. 37.083. DISCIPLINE MANAGEMENT PROGRAMS; BULLYING AND
7373 SEXUAL HARASSMENT POLICIES. (a) Each school district shall adopt
7474 and implement a discipline management program to be included in the
7575 district improvement plan under Section 11.252. The program must
7676 provide for prevention of and education concerning bullying,
7777 unwanted physical or verbal aggression, and sexual harassment[, and
7878 other forms of bullying in school, on school grounds, and in school
7979 vehicles].
8080 (b) Each school district shall [may] develop and implement a
8181 bullying and sexual harassment prevention policy to be included in
8282 the district improvement plan under Section 11.252. The policy
8383 must provide for:
8484 (1) the instruction of students regarding the elements
8585 of bullying and sexual harassment;
8686 (2) the action students should take in case of
8787 bullying or sexual harassment, including reporting an incident; and
8888 (3) the notification of the parents or guardians of
8989 each student involved in an incident of bullying or sexual
9090 harassment.
9191 SECTION 5. Section 39.053(a), Education Code, is amended to
9292 read as follows:
9393 (a) Each board of trustees shall publish an annual report
9494 describing the educational performance of the district and of each
9595 campus in the district that includes uniform student performance
9696 and descriptive information as determined under rules adopted by
9797 the commissioner. The annual report must also include:
9898 (1) campus performance objectives established under
9999 Section 11.253 and the progress of each campus toward those
100100 objectives, which shall be available to the public;
101101 (2) the performance rating for the district as
102102 provided under Section 39.072(a) and the performance rating of each
103103 campus in the district as provided under Section 39.072(c);
104104 (3) the district's current special education
105105 compliance status with the agency;
106106 (4) a statement of the number, rate, and type of
107107 incidents of bullying, harassment, sexual harassment,
108108 discrimination, and violent or criminal incidents against any
109109 student on the basis of the actual or perceived race, ethnicity,
110110 color, religion, gender, gender identity or expression, sexual
111111 orientation, national origin, or disability of the alleged
112112 perpetrator or victim that occurred on each district campus, to the
113113 extent permitted under the Family Educational Rights and Privacy
114114 Act of 1974 (20 U.S.C. Section 1232g);
115115 (5) information concerning bullying, harassment,
116116 sexual harassment, and school violence prevention and [violence]
117117 intervention policies and procedures that the district is using to
118118 protect students; [and]
119119 (6) the findings that result from evaluations
120120 conducted under the Safe and Drug-Free Schools and Communities Act
121121 [of 1994] (20 U.S.C. Section 7101 et seq.) [and its subsequent
122122 amendments]; and
123123 (7) information received under Section 51.403(e) for
124124 each high school campus in the district, presented in a form
125125 determined by the commissioner.
126126 SECTION 6. This Act applies beginning with the 2009-2010
127127 school year.
128128 SECTION 7. This Act takes effect immediately if it receives
129129 a vote of two-thirds of all the members elected to each house, as
130130 provided by Section 39, Article III, Texas Constitution. If this
131131 Act does not receive the vote necessary for immediate effect, this
132132 Act takes effect September 1, 2009.
