| 7 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 8 | 8 | | SECTION 1. Section 135.011, Education Code, is amended to |
|---|
| 9 | 9 | | read as follows: |
|---|
| 10 | 10 | | Sec. 135.011. DEFINITIONS. In this chapter [section]: |
|---|
| 11 | 11 | | (1) "Board" means the board of regents of the Texas |
|---|
| 12 | 12 | | State Technical College System. |
|---|
| 13 | 13 | | (2) "Coordinating board" means the Texas Higher |
|---|
| 14 | 14 | | Education Coordinating Board. |
|---|
| 15 | 15 | | (3) "System" means the Texas State Technical College |
|---|
| 16 | 16 | | System. |
|---|
| 17 | 17 | | (4) "Faculty research" means research using the |
|---|
| 18 | 18 | | system's facilities and equipment that is: |
|---|
| 19 | 19 | | (A) consistent with the system's mission; and |
|---|
| 20 | 20 | | (B) funded by private sources, competitively |
|---|
| 21 | 21 | | acquired sources, or appropriated public funding. |
|---|
| 22 | 22 | | (5) "Campus" means a residential unit of the system |
|---|
| 23 | 23 | | that grants associate degrees and certificates. |
|---|
| 24 | 24 | | (6) "Extension center" means a site, operating under |
|---|
| 25 | 25 | | the administration of a campus, that has an extension program. |
|---|
| 26 | 26 | | (7) "Extension program" includes credit and noncredit |
|---|
| 27 | 27 | | instruction in technical-vocational education. |
|---|
| 28 | 28 | | SECTION 2. Section 135.51, Education Code, is amended to |
|---|
| 29 | 29 | | read as follows: |
|---|
| 30 | 30 | | Sec. 135.51. CERTIFICATES, DIPLOMAS, AND ASSOCIATE |
|---|
| 31 | 31 | | DEGREES. (a) The board shall prescribe and award associate of |
|---|
| 32 | 32 | | applied science degrees, certificates, and diplomas limited to |
|---|
| 33 | 33 | | those appropriate to technical education. |
|---|
| 34 | 34 | | (b) The board may offer and award an associate of science |
|---|
| 35 | 35 | | degree in a field of study at Texas State Technical |
|---|
| 36 | 36 | | College--Harlingen campus if the coordinating board determines |
|---|
| 37 | 37 | | that the degree in that field of study: |
|---|
| 38 | 38 | | (1) is appropriate to the role and mission of the |
|---|
| 39 | 39 | | system; and |
|---|
| 40 | 40 | | (2) meets the educational or workforce needs of the |
|---|
| 41 | 41 | | region in which the campus is located. |
|---|
| 42 | 42 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 43 | 43 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 44 | 44 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 45 | 45 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 46 | 46 | | Act takes effect September 1, 2009. |
